RESOLUTION NO. 2024 - .3 7 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, RATIFYING THE EXPENDITURE OF FORFEITURE FUNDS FROM THE <br />DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNT FOR THE <br />PURCHASE OF A JEEP GLADIATOR RUBICON, IN AN AMOUNT NOT TO EXCEED <br />FORTY-SIX THOUSAND EIGHTY DOLLARS AND NO CENTS ($46,080.00); <br />AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE <br />CRIME CONTROL ACT OF 1984, TO EXPEND FORFEITURE FUNDS TO PURCHASE <br />UPGRADES FOR THE JEEP GLADIATOR RUBICON, AND FOR UPGRADES TO THE <br />CCN SYSTEM AT THE GOVERNMENT CENTER, IN AN AMOUNT NOT TO EXCEED <br />ONE HUNDRED NINETY-EIGHT THOUSAND SEVENTY-ONE DOLLARS AND SIXTY- <br />THREE CENTS ($198,071.63), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR <br />AN EFFECTIVE DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the City Commission wishes to ratify the purchase of a Jeep Gladiator Rubicon <br />(the "Vehicle"), in an amount not to exceed Forty -Six Thousand Eighty Dollars and No Cents <br />($46,080.00), and authorize the expenditure of forfeiture funds to purchase upgrades for the <br />Vehicle, and perform upgrades to the CCTV System at the Government Center, in an amount not <br />to exceed One Hundred Ninety -Eight Thousand Seventy -One Dollars and Sixty -Three Cents <br />($198,071.63), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Ratification of Expenditure of Federally Forfeited Monies. Based on the <br />certification, attached hereto as Exhibit "A", the City Commission hereby ratifies the expenditure <br />of funds from the Department of Justice federal forfeitures account for the purchase of a Jeep <br />Gladiator Rubicon (the "Vehicle"), in an amount not to exceed Forty -Six Thousand Eighty Dollars <br />and No Cents ($46,080.00). <br />Section 2. Expenditure of Federally Forfeited Monies. Based on the certification, attached <br />hereto as Exhibit "A", the Chief of Police is hereby authorized to expend One Hundred Ninety -Eight <br />Thousand Seventy -One Dollars and Sixty -Three Cents ($198,071.63), from the established <br />Department of Justice federal forfeitures account to purchase upgrades for the Jeep Gladiator <br />Rubicon, and perform upgrades to the CCTV System at the Government Center. <br />Section 3.
