RESOLUTION NO. 2024 - <br />,��Pv_ <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, WAIVING THE BIDDING REQUIREMENTS SET FORTH IN CHAPTER 62 <br />OF THE CITY CODE; APPROVING AN AGREEMENT WITH NUNEZ CONSTRUCTION <br />FOR THE INSTALLATION OF AN EMERGENCY GENERATOR AND BUILDING <br />RESTORATIONS AT GATEWAY COMMUNITY CENTER, IN AN AMOUNT NOT TO <br />EXCEED TWO MILLION TWO HUNDRED THIRTY-ONE THOUSAND NINE <br />HUNDRED TWENTY-ONE DOLLARS AND THIRTY-TWO CENTS ($2,231,921.32), <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO <br />ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City Commission of the City of Sunny Isles Beach (the "City") is in need of <br />a contractor to install an emergency generator and perform restoration services at Gateway <br />Community Center (the "Services"); and <br />WHEREAS, on June 20th, 2019, via Resolution No. 2019-2952, the City Commission <br />approved an Agreement with Nunez Construction (the "Contractor") for the interior build -out of <br />the Gateway Community Center (the "Project"); and <br />WHEREAS, between 2019-2022, the City Commission approved a total of 10 Change <br />Orders related to the Project; and <br />WHEREAS, by way of the Change Orders, the Contractor was asked to design an <br />emergency generator to service Gateway; and <br />WHEREAS, upon completion of the Project, the City is in a position to move forward with <br />the construction of the emergency generator; and <br />WHEREAS, upon careful review and consideration, the City Manager has determined <br />that it is in the best interest of the City to waive the bidding requirements to maintain work <br />performance quality, consistency, and continuity; and <br />WHEREAS, pursuant to section 62-12 of the City's Code of Ordinances, the City <br />Commission may authorize the waiver of competitive bidding procedures upon the <br />recommendation of the City Manager that it is in the best interest of the City to do so; and <br />WHEREAS, the City Commission wishes to approve an Agreement with the Contractor to <br />provide the Services, in an amount not to exceed One Million Five Hundred Six Thousand One <br />Hundred Eighty -Two Dollars and Fifty -Seven Cents ($1,506,182.57), which includes a 10% <br />contingency, for the installation of an emergency generator, and an amount not to exceed <br />Seven Hundred Twenty -Five Thousand Seven Hundred Thirty -Eight Dollars and Seventy Cents <br />($725,738.75), which includes a 10% contingency, for the building restoration services, for a <br />total contract amount not to exceed Two Million Two Hundred Thirty -One Thousand Nine <br />@BCL@7COBD51A.Doc Page 1 of 2 267 <br />
