consent of the City. As a condition to any assignment, the assignee shall agree in writing to <br />comply with and be bound by all of the terms, covenants, conditions, provisions and <br />agreements in this Contract. <br />14.3 Public Construction Bond <br />14.3.1. The Contractor shall furnish a Public Construction Bond to the City in an <br />amount not less than one hundred percent (100%) of the Contract Price. The bond <br />furnished by the Contractor shall incorporate by reference the terms of the Contract as fully <br />as though they were set forth verbatim in such bonds. In the event the Price is adjusted by <br />Change Order executed by the Contractor, the penal sum of the bond shall be deemed <br />increased by like amount. The bond furnished by the Contractor shall be in form required <br />by the City and in conformity with Section 255,05, Florida Statutes, shall be recorded in the <br />Public Records of Miami -Dade County before construction commences, and shall be <br />executed by a surety, or sureties, reasonably suitable to the City. <br />14.4 Non -Discrimination <br />14.4.1. The Contractor warrants and represents that all of its employees are treated <br />equally during employment without regard to race, color, national origin, sex, gender <br />identity, sexual orientation, age, disability/handicap, religion, family or income status. <br />14.5 Discriminatory Vendor List <br />14.5.1. Pursuant to Section 287.134, Florida Statutes, an entity or affiliate who has <br />been placed on the discriminatory vendor list may not submit a bid, proposal, or reply on a <br />contract to provide any goods or services to a public entity; may not submit a bid, proposal, <br />or reply on a contract with a public entity for the construction or repair of a public building <br />or public work; may not submit bids, proposals, or replies on leases of real property to a <br />public entity; may not be awarded or perform work as a contractor, supplier, subcontractor, <br />or consultant under a contract with any public entity; and may not transact business with <br />any public entity. By execution of this Contract, Contractor represents that it has not been <br />placed on the discriminatory vendor list as provided in Section 287.134, Florida Statutes. <br />14.6 Public Entity Crimes'' <br />14.6.1. Pursuant to Section 287.133, Florida Statutes, a person or affiliate who has <br />been placed on the convicted vendor list following a conviction for a public entity crime may <br />not submit a bid, proposal, or reply on a contract to provide any goods or services to a <br />public entity; may not submit a bid, proposal, or reply on a contract with a public entity for <br />the construction or repair of a public building or public work; may not submit bids, <br />proposals, or replies on leases of real property to a public entity; may not be awarded or <br />perform work as a contractor, supplier, subcontractor, or consultant under a contract with <br />Page 38 of 43 <br />306 <br />
