RESOLUTION NO. 2024 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING AN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY <br />FOR THE PUBLICATION OF LEGAL ADVERTISEMENTS AND PUBLIC NOTICES ON <br />MIAMI-DADE COUNTY'S PUBLICLY ACCESSIBLE WEBSITE; AUTHORIZING THE <br />MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER AND <br />THE CITY CLERK TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the Florida Constitution requires all meetings of a county, municipality, school <br />board, or special district at which official acts are to be taken or at which public business is to be <br />discussed or transacted to be open to the public and properly noticed; and <br />WHEREAS, the City of Sunny Isles Beach (the "City"), like many other municipalities in <br />Miami -Dade County (the "County"), historically published legal notices in newspapers of general <br />circulation; and <br />WHEREAS, Section 50.0311, Florida Statutes, provides that a governmental agency may use <br />the designated publicly accessible website of the county in which it lies to publish legally required <br />advertisements and public notices if the cost of publishing advertisements and public notices on <br />such website is less than the cost of publishing advertisements and public notices in a newspaper; <br />and <br />WHEREAS, in April 2024, the County Board of County Commissioners ("BCC") adopted <br />Resolution No. R-281-24, which, among other things, directed the County Mayor's administration <br />to take all necessary steps to provide for publication of municipal legal advertisements and public <br />notices on a publicly accessible website of the County in accordance with Section 50.0311, Florida <br />Statutes; and <br />WHEREAS, in July, 2024, the County BCC designated "legal ads. miamidade.gov" (the <br />"Website") as the County's publicly accessible website, approved the form of interlocal agreement <br />(the "Agreement"), attached hereto as Exhibit "A", for the publication of municipal legal <br />advertisements and public notices on the Website, and authorized the County Mayor or County <br />Mayor's designee to execute the Agreement with any governmental agencies within the County <br />relating to the same; and <br />WHEREAS, the estimated annual cost for the software, maintenance, and support <br />necessary for the publication of municipal legal advertisements and public notices on the Website <br />is Seven Hundred Seven Dollars and No Cents ($707.00) per authorized City employee user per <br />year, which is less than the cost of advertising in a newspaper of general circulation in the County; <br />and <br />WHEREAS, the City Commission wishes to approve the Agreement, attached here to as <br />Exhibit "A", to publish the City's legal advertisements and public notices on the Website. <br />@BCL@5C0B296B.doc Page 1 of 2 377 <br />
