RESOLUTION NO. 2024 - 393 Z - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AWARDING INVITATION TO BID NO. 24-07-02 TO, AND APPROVING <br />AN AGREEMENT WITH, MBR CONSTRUCTION TO PROVIDE CONSTRUCTION <br />SERVICES FOR THE INTRACOASTAL SPORTS PARK, IN AN AMOUNT NOT TO <br />EXCEED THREE MILLION FIVE HUNDRED SEVENTEEN THOUSAND FIVE <br />HUNDRED THIRTY-NINE DOLLARS AND FOUR CENTS ($3,517,539.04), <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE <br />SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, the City of Sunny Isles Beach (the "City") is in need of a contractor to provide <br />construction services for the Intracoastal Sports Park (the "Services"); and <br />WHEREAS, on July 25, 2024, the City issued Invitation to Bid No. 24-07-02, titled <br />Construction of Intracoastal Sports Park, and received nine (9) submissions for interested <br />bidders; and <br />WHEREAS, upon careful review and consideration, MBR Construction, Inc. (the <br />"Contractor") was determined to be the lowest responsive and responsible bidder; and <br />WHEREAS, the Contractor is a certified and insured entity with the necessary experience <br />to provide the desired Services; and <br />WHEREAS, the City Commission wishes to approve an Agreement with the Contractor to <br />provide the desired Services, in an amount not to exceed Three Million Five Hundred Seventeen <br />Thousand Five Hundred Thirty -Nine Dollars and Four Cents ($3,517,539.04), which includes a <br />contingency in the amount of Three Hundred Nineteen Thousand Seven Hundred Seventy -Six <br />Dollars and Twenty -Eight Cents ($319,776.28), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of Agreement. The City Commission hereby approves an Agreement <br />with MBR Construction to provide construction services for the Intracoastal Sports Park, in an <br />amount not to exceed Three Million Five Hundred Seventeen Thousand Five Hundred Thirty - <br />Nine Dollars and Four Cents ($3,517,539.04), which includes a contingency in the amount of <br />Three Hundred Nineteen Thousand Seven Hundred Seventy -Six Dollars and Twenty -Eight Cents <br />($319,776.28), attached hereto as Exhibit "A". <br />Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said. <br />Section 3. Authorization of City Manager.
