As part of the Applicant's <br />submission for approval of the Project, the Applicant respectfully requests approval for the <br />release of an existing Declaration of Restrictions and Grant of Easement ('Existing Declaration') <br />recorded in Official Record Book 26192 at Page 1195 of the Public Records of Miami Dade <br />County, a copy of which is attached hereto, and acceptance of a new Declaration of Restrictions <br />and Grant of Easement ( "New Declaration "). <br />By way of background, on November 17, 2005, the City Commission approved <br />Resolution No. 05 -Z -98, which permitted the development of a project at 15701 Collins Avenue. <br />The project encompassed a 51- story condominium tower containing 134 residential units and <br />140 hotel rooms. In conjunction with the approval of the project, the then developer filed the <br />Existing Declaration.
