RESOLUTION NO. 2024 - =0 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, REVERSING THE DECISION OF THE HISTORIC PRESERVATION BOARD TO <br />DENY A SPECIAL CERTIFICATE OF APPROPRIATENESS FOR DEMOLITION OF THE <br />STRUCTURE LOCATED 334 ATLANTIC AVENUE; APPROVING THE ISSUANCE OF A <br />SPECIAL CERTIFICATE OF APPROPRIATENESS FOR DEMOLITION OF THE <br />STRUCTURE LOCATED 334 ATLANTICAVENUE; AUTHORIZING THE CITY MANAGER <br />TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br />FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach (the "City") created a Historic Preservation Board <br />("HPB"), with certain powers and duties, as enumerated in Section 171-3 of the City's Code of <br />Ordinances, including the approval or denial of Certificates of Appropriateness ("COA"); and <br />WHEREAS, the structure located at 334 Atlantic Avenue (Folio No. 31-2214-003-0550) was <br />designated as a historical landmark by Miami -Dade County in 1984, and redesignated as such by <br />the City in 2005 via Resolution No. 2005-808 ("Subject Structure"); and <br />WHEREAS, on or about August 25, 2023, George H. Scholl ("Property Owner") submitted an <br />application for a Special COA for the demolition of the Subject Structure; and <br />WHEREAS, on May 7, 2024 and on September 11, 2024, the Property Owner presented his <br />application to the HPB for a Special COA for demolition of the Subject Structure, which was denied <br />by the HPB; and <br />WHEREAS, the Property Owner timely submitted an appeal of the HPB's denial of the <br />Special COA to the City Commission, pursuant to Section 171-4 (D) of the City's Code of Ordinances; <br />and <br />WHEREAS, having held a public hearing and upon consideration of all facts material to the <br />appeal, the City Commission wishes to reverse the decision of the HPB and grant the Special COA to <br />the Property Owner for demolition of the Subject Structure; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Reversal of Decision. The City Commission hereby reverses the decision of the <br />Historic Preservation Board to denythe issuance of a Special Certificate of Appropriateness for the <br />demolition of the structure located at 334 Atlantic Avenue (Folio No. 31-2214-003-0550). <br />Section 2. Approval of Special Certificate of Appropriateness. The City Commission hereby <br />approves the issuance of a Special Certificate of Appropriateness for demolition of the structure <br />located at 334 Atlantic Avenue (Folio No. 31-2214-003-0550). <br />Section 3.
