Section 4. Conditions. <br />1. That the plans shall be substantially in accordance with that submitted for public hearing, <br />which are entitled "St. Regis Residences", prepared by Arquitectonica, stamped received <br />on January 10, 2025, consisting of 82 sheets. Additionally, the landscaping plans entitled <br />"St. Regis Sunny Isles Residences", prepared by EDSA, stamped received on December 6, <br />2024, consisting of 55 sheets. The civil plans entitled "St. Regis Residences", prepared by <br />Fortin, Leavy, Skiles, Inc., stamped received on June 7, 2024, consisting of 12 sheets. <br />2. Upon the submittal of an application for a building permit, the plans submitted shall be <br />approved by the Planning and Zoning Department and be consistent with the specific site <br />plan approved by the City Commission. Plans shall include all the required elements of <br />the site plan pursuant to the City's Land Development Regulations and recommendations. <br />Should compliance with recommendations result in a change that would not be <br />considered "minor" in accordance with Section 265-18 of the City Code; the Applicant <br />shall be required to obtain another approval of the City Commission. <br />3. All conditions and approvals enumerated under Resolution Nos. 15-Z-156, 2015-2497, 16- <br />Z-158, 2016-2511, 2017-2656, and 22-Z-189 shall remain in effect, unless modified or <br />deleted as part of this application. <br />4. Resolution 22-Z-189, Section 4.1., Condition number 3 shall be revised to eliminate the <br />shared parking agreement from the required Declaration of Restrictive Covenant and <br />recognize the reduction of cabanas to 14 and guest suites to 10. <br />5. The Applicant shall address comments provided by the City's Landscape Architect <br />Consultant regarding landscape plans per the memo dated 12/18/2024 prior to issuance <br />of building permit. The City Manager or designee shall review and provide additional <br />comments if necessary. <br />6. Development signage must conform to requirements of the Land Development <br />Regulations and will be addressed prior to issuance of building permit. <br />7. Loading spaces shall not be located in the front yard, which is between the building and <br />Collins Avenue. <br />8. All elements of the arrival features, water features, walls, development signage, and <br />sculpture podium bases shall not encroach into the 10' landscape easement along Collins <br />Avenue., <br />9. That the Applicant shall pay all fees related to the review of the application described <br />herein and shall have paid all other fees due to the City. <br />D <br />
