PZ2025-04) SUBMITTED BY YEHUDA GABAY (THE <br />"APPLICANT") FOR A VARIANCE FROM THE APPLICATION OF THE DEFINITION OF <br />"LOT LINE, FRONT" OF SECTION 265-5 OF THE CITY'S LAND DEVELOPMENT <br />REGULATIONS, FOR A VARIANCE FROM THE POOL SETBACK REQUIREMENTS OF <br />SECTIONS 265.31.D. AND 265-45.1 OF THE CITY'S LAND DEVELOPMENT <br />REGULATIONS, FROM SEVENTEEN FEET (17') TO FOUR (4) FEET AND ELEVEN <br />INCHES (4'-11"), FOR A VARIANCE FROM THE FRONT YARD SETBACK <br />REQUIREMENTS OF SECTION 265.31.1) OF THE CITY'S LAND DEVELOPMENT <br />REGULATIONS, BY FOUR FEET AND TEN INCHES (4'-10"), FOR A VARIANCE <br />FROM THE CORNER SIDE SETBACK REQUIREMENTS OF SECTION 265.31.1) OF THE <br />CITY'S LAND DEVELOPMENT REGULATIONS, BY THREE FEET (3'), FOR A <br />VARIANCE FROM THE SIDE SETBACK REQUIREMENTS OF SECTION 265.31.1) OF <br />THE CITY'S LAND DEVELOPMENT REGULATIONS, BY TWO FEET (2'), AND FOR A <br />VARIANCE FROM THE REAR SETBACK REQUIREMENTS OF SECTION 265.31.1) OF <br />THE CITY'S LAND DEVELOPMENT REGULATIONS, BY FOUR FEET (4'), AT THE <br />PROPERTY LOCATED AT 201189 TERRACE, SUNNY ISLES BEACH; PROVIDING THE <br />CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING <br />FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE <br />WHEREAS, The Applicant submitted a zoning variance application, numbered PZ2025-04 <br />(the "Application"), to the City of Sunny Isles Beach, Florida ("City") requesting the following: <br />1. Pursuant to Section 265-5 of the City of Sunny Isles Beach Land Development Regulations, <br />the Applicant requests a variance from the application of the definition of "Lot Line, <br />Front" to consider the widest street frontage as the front lot line, instead of the narrowest <br />street frontage on a corner lot. <br />2. Pursuant to Sections 265-31.D. and 265-45.1. of the City of Sunny Isles Beach Land <br />Development Regulations, the Applicant requests a variance from the pool setback <br />requirements to decrease the minimum street side pool setback from seventeen feet <br />(17') to four feet and eleven inches (4'-11"). <br />3. Pursuant to Section 265-31.D. of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant requests a variance from the front yard setback requirements <br />
