RESOLUTION NO. 2025 -tel l - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, EXPRESSING SUPPORT FOR FLORIDA SENATE BILL 440, RELATING TO <br />GENDER IDENTITY EMPLOYMENT PRACTICES; DIRECTING THE CITY CLERK TO <br />TRANSMIT COPIES OF THIS RESOLUTION; AUTHORIZING THE CITY MANAGER TO <br />DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, Florida State Senator Stan McClain introduced Senate Bill 440 ("SB 440"), also <br />known as the "Freedom of Conscience in the Workplace Act," which establishes policies <br />regarding gender identity, pronoun usage, and employment practices within state and local <br />government entities; and <br />WHEREAS, SB 440 prohibits employees and contractors of government entities from <br />being required to use pronouns that do not correspond to an individual's biological sex and <br />protects employees from adverse personnel actions based on deeply held religious, moral, <br />conscience -based, or biology -based beliefs; and <br />WHEREAS, SB 440 also restricts government job applications from offering nonbinary or <br />other gender -related options beyond male or female and prevents government entities from <br />mandating certain training or activities related to gender identity as a condition of employment; <br />and <br />WHEREAS, the City Commission of the City Sunny Isles Beach (the "City") supports policies <br />that protect employees' rights to freedom of speech and religious expression while maintaining <br />a respectful and professional workplace environment; and <br />WHEREAS, SB 440 aligns with the City's commitment to ensuring that employment <br />policies within government entities are fair, legally sound, and uphold constitutional freedoms; <br />and <br />WHEREAS, the City Commission finds it in the best interest of its employees and residents <br />to express support for SB 440. <br />NOW, THEREFORE, BE RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Express Support of Senate Bill 440. The City Commission hereby expresses its <br />support of Senate Bill 440. <br />Section 2. Direction to the City Clerk. The City Clerk is hereby directed to distribute copies <br />of this Resolution to the Florida League of Cities, the President of the Florida Senate, the Speaker <br />of Florida House of Representatives, the Governor of the State of Florida, Florida Senator Stan <br />McClain. <br />@BCL@5C0968DF.docx Page 1 of 2 <br />
