RESOLUTION NO. 2014 - _Z!P)_q0 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, APPROVING A <br />REQUEST SUBMITTED BY DEZER BLUEGRASS, LLC TO <br />NAIVE THE LANDSCAPING AND FRONT SETBACK <br />REQUIREMENTS FOR THE CONSTRUCTION FENCE KITH <br />GRAPHICS AT THE BLUEGRASS SITE LOCATED AT 18325 <br />COLLINS AVENUE; ESTABLISHING CONDITIONS FOR THE <br />RELOCATION OF THE CONSTRUCTION FENCE; <br />APPROVING THE MURALS AND GRAPHICS; PROVIDING <br />THE CITY MANAGER AND CITY ATTORNEY WITH THE <br />AUTHORITY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, on or about November 4, 2014. Dezer Bluegrass. LLC. ( "Applicant ") <br />submitted a request to the City of Sunny Isles Beach; Florida to waive the landscaping and front <br />setback requirements and approval of graphics at the construction fence for the Bluegrass site to <br />facilitate the construction of the future project; and <br />WHEREAS. the City Commission wishes to approve the waiver to permit the Applicant <br />with the flexibility to install the construction fence with graphics without the required setback and <br />landscaping buffer. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are <br />incorporated herein by reference as if they are fully set forth herein. <br />Section 2. Waiver. The City Commission hereby approves the waiver of the landscape and <br />setback requirements set forth in Section 265 -63.3 E. of the City Code; subject to the conditions <br />below. <br />Section 3. Murals and Graphics Approval. The City Commission hereby approves the graphics <br />proposed by the Applicant as set forth in Section 265 -63 -3 G. of the City Code. <br />Section 4. Conditions of Approval. The Applicant is required to comply with the following <br />conditions: <br />1. The construction fence shall be maintained in good condition at all times. <br />2. That the sidewalk shall be maintained clean and in good condition at all times. <br />
