RESOLUTION NO. 2014- 2aS8 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, DIRECTING THE ZONING ADMINISTRATOR TO ADMINISTRATIVELY CLOSE A PRIVATE TRANSFER OF DEVELOPMENT RIGHTS ( "TDRs ") SUB - ACCOUNT FOR TEMPLE B'NAI ZION; PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission directed the Zoning Administrator to create a private Transfer of Development Rights ( "TDRs ") sub - account for Temple B'Nai Zion. Inc. (the "Temple ") as part of the parties' settlement in the lawsuit styled "Temple B'Nai Zion. Inc. v. City of Sunny Isles Beach, et al. Case No. 10 -24 49- CIV -KMW' ; and WHEREAS, the City Commission wishes to administratively close the Temple's sub - account of 15,000 square feet of floor area and five (5) dwelling units as a result of the sale of such TDRs. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they are fully set forth herein. Section 2. Directing the Zoning Administrator to administratively close a private TDR sub - account. The City Commission hereby directs the Zoning Administrator to administratively close a private Transfer of Development Rights ("TDRs") sub - account for Temple B'Nai Zion, Inc. Section 3. Authority of the City Manager and City Attorney. The City Manager and City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date.
