City of Sunny Isles Beach 18070 Collins Avenue, Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 phone (305) 949-3113 Fax <br />• Premises and Operation; <br />• Independent Contractors; <br />• Products and/or Completed Operations Hazard; <br />• Broad Form Property Damage <br />• Broad Form Contractual Coverage applicable to this Contract, including any <br />hold harmless and/or Indemnification Agreement; <br />• Personal Injury Coverage with Employee and Contractual Exclusions removed, <br />with minimum limits of coverage equal to those required for Bodily <br />Injury Liability and Property Damage Liability; <br />• $3,000,000 Umbrella/Excess Liability over and above and following the above <br />mentioned General Liability & Business Automobile Liabilities. <br />13.3 Business Automobile Liability. Contractor agrees to maintain Business <br />Automobile Liability at a limit of liability not less than $1,000,000 per Occurrence combined <br />single limit for Bodily Injury Liability and Property Damage Liability. Coverage must be afforded <br />on a form no more restrictive than the latest edition of the Business Automobile Liability policy, <br />without restrictive endorsements, as filed by the Insurance Services Office, and must include: <br />Owned, Non -Owned & Hired automobiles, and Employers' Non -City ship. <br />13.4 Worker's Compensation & Employer's Liability. Contractor agrees to maintain <br />Worker's Compensation & Employers Liability Insurance in accordance with Florida Statutes, <br />including Employer's Liability of $1,000,000. <br />13.5 Builder's Risk Insurance. Coverage shall be "All Risk" coverage for one hundred <br />percent (100%) of the completed value of the structure(s), building(s) or addition(s). Where the <br />contract calls for install of machinery or equipment, the policy must be endorsed to provide <br />coverage on "All Risk" basis during transit and installation. The policy must be issued with a <br />deductible of not more than $50,000 per claim. <br />13.6 Waiver of Subro ag tion. Contractor agrees by entering into this written Contract to a <br />Waiver of Subrogation in favor of the City, Contractor, Sub -Contractors, Architects, or Engineer <br />for each required policy providing coverage during the life of this Contract. When required by <br />the insurer, or should a policy condition not permit the Contractor to enter into a pre -loss Contract <br />to waive subrogation without an endorsement, the Contractor agrees to notify the insurer and <br />request the policy be endorsed with a Waiver of Transfer of Rights of Recovery Against Others, <br />or an equivalent endorsement. This Waiver of Subrogation requirement shall not apply to any <br />policy, which includes a condition that specifically prohibits such an endorsement, or voids <br />coverage should the Contractor enter into such Contract on a pre -loss basis. <br />13.7 Right to Revise or Reject. Contractor agrees the City reserves the right, but not the <br />obligation, to review or revise any insurance requirement, not limited to limits, coverages and <br />endorsements based on insurance market conditions affecting the availability or affordability of <br />coverage; or changes in the scope of work specifications affecting the applicability of <br />coverage. Additionally, the City reserves the right, but not the obligation, to review and reject <br />any insurance policies failing to meet the criteria stated herein, or any insurer(s) providing <br />COMTECH ENGINEERING, INC. 34 <br />
