RESOLUTION NO.2026 - ? <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, EXPRESSING SUPPORT FOR A PROPOSED ORDINANCE OF MIAMI- <br />DADE COUNTY AMENDING SECTION 21-28 OF THE CODE OF MIAMI-DADE <br />COUNTY, FLORIDA, RELATING TO NOISE REGULATIONS; DIRECTING THE CITY <br />CLERK TO TRANSMIT COPIES OF THIS RESOLUTION; AUTHORIZING THE CITY <br />MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, Miami -Dade County (the "County") has proposed an ordinance amending <br />Section 21-28 of the Code of Miami -Dade County, Florida, relating to noise regulations, <br />including modifying the circumstances that establish a prima facie violation governing radios, <br />televisions, and similar sound -producing devices; and <br />WHEREAS, the proposed ordinance would reduce the existing 100-foot plainly audible <br />standard to 25 feet as it relates to vehicles, vessels, and floating structures, while maintaining <br />the 100-foot standard for buildings and non -floating structures; and <br />WHEREAS, the City of Sunny Isles Beach (the "City") is a coastal community with <br />significant residential density, waterways, and public roadways, and excessive noise from <br />vehicles and vessels can adversely affect the health, safety, and welfare of residents and <br />visitors; and <br />WHEREAS, the City Commission finds that the proposed amendment promotes quality of <br />life and supports reasonable noise regulation to protect the peaceful enjoyment of property; <br />and <br />WHEREAS, the City Commission finds that it is in the best interests of its residents to <br />express support for the County's proposed ordinance. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Express Support. The City Commission hereby expresses its support for the <br />proposed County's ordinance amending Section 21-28 of the Code of Miami -Dade County, <br />Florida, relating to noise regulations. <br />Section 2. Direction to the City Clerk. The City Clerk is hereby directed to transmit copies of <br />this Resolution to the Miami -Dade County Mayor and the Miami -Dade County Board of County <br />Commissioners. <br />Section 3. Authorization of the City Manager. The City Manager is hereby authorized to do <br />all things necessary to effectuate the terms of this Resolution. <br />Section 4. Effective Date.
