LOCAL PLANNING AGENCY RESOLUTION NO. 2026 - A( <br />A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE CITY OF SUNNY ISLES <br />BEACH, FLORIDA, RECOMMENDING TO THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, TO AMEND CHAPTER 265, ARTICLE IX, SECTION 265-53, <br />ENTITLED "REQUIRED SIGNS; NO PERMIT REQUIRED," OF THE CODE OF <br />ORDINANCES OF THE CITY OF SUNNY ISLES BEACH, REQUIRING THE POSTING <br />OF CERTAIN SIGNS AT COMMUNITY AND COMMERCIAL SWIMMING POOLS; <br />PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE <br />DATE. <br />WHEREAS, Chapter 166, Florida Statutes, confers upon local governments the authority <br />to adopt regulations designed to promote the public health, safety, and general welfare of its <br />citizenry; and <br />WHEREAS, The State of Florida routinely ranks among the highest nationally for pool <br />drownings; and <br />WHEREAS, having a visible address in conspicuous areas of public pools can reduce <br />emergency services response times; and <br />WHEREAS, the City Commission of the City of Sunny Isles Beach (the "City") desires to <br />provide additional means of preventing deaths related to pool drowning; and <br />WHEREAS, the City Commission finds that the amendments set forth herein will aid in <br />the reduction of pool -related deaths in public pools and promote the public health, safety, and <br />welfare of the City. <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS': <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br />upon adoption hereof. <br />Section 2. Recommended Amendment of Chapter 265, Article IX, Section 265-53.
