RESOLUTION NO. 2026 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A SECOND AMENDMENT TO THE AGREEMENT WITH <br />TEAM CONTRACTING, INC., FOR THE INSTALLATION OF A NEW, PRE- <br />ENGINEERED METAL BUILDING, IN AN AMOUNT NOTTO EXCEED TWO HUNDRED <br />THIRTY-FOUR THOUSAND TEN DOLLARS AND FIFTY-FIVE CENTS ($234,010.55), <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE <br />SAID AMENDMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, on September 19, 2024, via Resolution No. 2024-3717, the City Commission <br />of the City of Sunny Isles Beach (the "City") approved an Agreement with TEAM Contracting, Inc. <br />(the "Contractor") to install the roof and walls of a new, pre-engineered metal building (the <br />"Structure") for a workshop and storage for the City's Public Works Department, in an amount <br />not to exceed $290,000.00; and <br />WHEREAS, on May 15, 2025, via Resolution No. 2025-3839, the City Commission <br />approved a First Amendment to the Agreement with the Contractor for the excavation, <br />foundation, and installation of utilities, and installation of soundproofing in the Structure, in an <br />amount not to exceed $160,294.18; and <br />WHEREAS, on -site geotechnical testing identified silty sand, creating an unforeseen <br />structural risk that necessitates the installation of 110 helical piles to ensure building stability, <br />and additional design and engineering services, including structural, fire, mechanical, and <br />electrical work, are required to meet installation and code -compliance requirements ("Additional <br />Services"); and <br />WHEREAS, the Additional Services adds an additional Sixty -Five (65) days for final <br />completion ("Time Extension"); and <br />WHEREAS, the Contractor has provided the City with a proposal for the Additional <br />Services; and <br />WHEREAS, the City Commission wishes to approve a Second Amendment to the <br />Agreement with the Contractor for the Additional Services and Time Extension, in an amount not <br />to exceed Two Hundred Thirty -Four Thousand Ten Dollars and Fifty -Five Cents ($234,010.55), <br />bringing the total contract amount not to exceed Six Hundred Eighty -Four Thousand Three <br />Hundred Four Dollars and Seventy -Three Cents ($684,304.73), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of Second Amendment.
