RESOLUTION NO. 2026 - -t �•� <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A FIRST AMENDMENT TO THE AGREEMENT WITH RGEN <br />ENTERPRISES, LLC, d/b/a COOL WATER AIR CONDITIONING, FOR <br />PREVENTATIVE MAINTENANCE SERVICES OF HVAC MANAGEMENT SYSTEMS <br />LOCATED AT GATEWAY PARK, PELICAN COMMUNITY PARK, PUBLIC WORKS <br />COMPOUND, THE SPOT, HERITAGE PARK, AND TOWN CENTER <br />PARK/MEDITATION GARDEN, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED <br />THOUSAND DOLLARS AND NO CENTS ($100,000.00); ATTACHED HERETO AS <br />EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; <br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, July 17, 2025, via Resolution No. 2025-3853, the City Commission of the City <br />of Sunny Isles Beach (the "City") awarded Invitation to Bid No. 25-06-01 for Citywide HVAC <br />Management System Preventative Maintenance Services (the "ITB"); and <br />WHEREAS, via Resolution No. 2025-3853, the City Commission also approved an <br />Agreement with RGEN Enterprises, LLC. d/b/a Cool Water Air Conditioning ("the Contractor"), <br />in an amount not to exceed $100,000.00, to provide preventative maintenance services for the <br />HVAC management system located at Gateway Park, Pelican Community Park, Public Works <br />Compound, The Spot, Heritage Park, and Town Center Park/Meditation Garden (the "Services"); <br />and <br />WHEREAS, due to frequent use of the Services provided by the Contractor, allocated <br />funds have significantly reduced; and <br />WHEREAS, additional funding is required to maintain continuity of operations, and to <br />ensure any ongoing and unforeseen repairs are addressed; and <br />WHEREAS, the City Commission wishes to approve a First Amendment to the Agreement <br />with the Contractor for the desired Services, in an amount not to exceed One Hundred <br />Thousand Dollars and No Cents ($100,00.00), bringing the total contract amount not to exceed <br />Two Hundred Eighty -Three Thousand Six Hundred Dollars and No Cents ($283,600.00), attached <br />hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of First Amendment. The City Commission hereby approves a First <br />Amendment to the Agreement with the Contractor for the desired Services, in an amount not to <br />exceed One Hundred Thousand Dollars and No Cents ($100,00.00), bringing the total contract <br />amount not to exceed Two Hundred Eighty -Three Thousand Six Hundred Dollars and No Cents <br />($283,600.00), attached hereto as Exhibit "A". <br />@BCL@F4166C20 Page 1 of 2 311 <br />
