Be The Light Decor | RFP 26-04-01 — Citywide Holiday Lighting & Decorating Services <br />Page 28 of 55 <br />are issued within 60 minutes of notification. The Contractor will ensure all City holiday lights and <br />decorations are functioning by 5:00 PM each day during the Holiday Lighting Season (RFP §3.1). <br /> <br />Per RFP §3.11, professional technicians are available 24 hours per day, 7 days a week on a 2-hour <br />response basis for repair and restoration. The 8-hour on-site response in RFP §3.1 represents the City's <br />reportable performance threshold; our standard practice is faster. <br /> <br />9.4 Liquidated Damages — RFP §3.3 <br />Be The Light Decor acknowledges RFP §3.3 and accepts that the City may assess $300 per day in <br />liquidated damages if non-functional lights or decorations are not repaired or replaced within 8 hours of <br />notification. Our response framework is structured to avoid any such assessment. <br /> <br />9.5 Safety <br />• OSHA-compliant (29 CFR 1910 General Industry; 29 CFR 1926 Construction). All field crew hold <br />OSHA 10; supervisors hold OSHA 30. <br />• Aerial-lift, scissor-lift, and bucket-truck operator certifications maintained for all operators. <br />• Fall protection program for elevated work; Lockout/Tagout for electrical work. <br />• HazCom program; current SDS library available on site. <br />• Daily safety stand-up before each shift; documented JHA for each work zone. <br />• PPE: Class 2 high-visibility apparel, hard hats, fall protection, electrical-safety PPE. <br />• MUTCD-compliant MOT plans submitted in advance for any work in FDOT or City rights-of-way; <br />coordination with FDOT and City Public Works as required. <br />• All employees pass FDLE FCIC/NCIC Level 2 criminal background check at $67.75 per person — <br />included in pricing (RFP §2.10; Addendum 3, Q32). <br /> <br />9.6 Compliance — Local, State, and Federal (RFP §3.8) <br />• Occupational Safety and Health Act (OSHA) <br />• Florida Building Code, 7th Edition (2020) and all referenced standards <br />• National Electric Code <br />• UL Listed materials <br />• Equal Employment Opportunity (EEO) <br />• Americans with Disabilities Act (ADA) <br />• Miami-Dade County Conflicts of Interest Section 2-11 <br />• FDOT Standard Plans and Specifications for Road and Bridge Construction <br />• MUTCD — Manual on Uniform Traffic Control Devices <br /> <br />9.7 Insurance Coverages (RFP §2.11) <br />Coverages in force and to be maintained throughout the contract term:
