ORDINANCE 2026 - (A <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A FIRST AMENDMENT TO THE LEASE AGREEMENT <br />BETWEEN THE CITY OF SUNNY ISLES BEACH AND LA PLAYA BEACH ASSOCIATES, <br />LLC. FOR THE LEASED PREMISES LOCATED AT 18590 COLLINS AVENUE, SUNNY <br />ISLES BEACH, FLORIDA; AUTHORIZING THE MAYOR TO EXECUTE SAID LEASE <br />AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, on May 1611, 2024, via Ordinance No. 2024-612, the City Commission of the <br />City of Sunny Isles Beach, Florida, (the "City") approved a Lease Agreement with La Playa Beach <br />Associates, LLC. ("Lessee") of the land located at 18590 Collins Avenue, Sunny Isles Beach, <br />Florida ("Leased Premises"); and <br />WHEREAS, the Lease Agreement included an initial term of 42-months; and <br />WHEREAS, the Lessee has expressed their desire to extend the initial term of the Lease <br />Agreement for an additional 24-months ("Lease Extension"); and <br />WHEREAS, the City Commission wishes to approve the First Amendment to Lease <br />Agreement between the City and the Lessee for the Leased Premises to add a 24-month Lease <br />Extension, for a total initial lease term of Sixty -Six (66) months, with five (5) one (1) year renewal <br />options at the City's sole discretion, attached hereto, in substantially the form, as Exhibit "A". <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS:' <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part of this Ordinance <br />upon adoption hereof. <br />Section 2. Approval of First Amendment. The City Commission hereby approves the First <br />Amendment to Lease Agreement between the City and the Lessee for the Leased Premises to <br />add a 24-month Lease Extension, for a total initial lease term of Sixty -Six (66) months, with five <br />(5) one (1) year renewal options at the City's sole discretion, attached hereto, in substantially <br />the form, as Exhibit "A". <br />Section 3. Effective Date.
