Daily pricing will run Midnight to Midnight. <br />SPECIFICATIONS: All Products shall comply with the Kinder Morgan CFPL specifications In Florida. <br />RATABILITY: Port's obligation to buy and take delivery of product hereunder shall be subject to the daily and <br />monthly tolerances specified in Table 3 below. For the avoidance of doubt, MXE shall have no obligation to sell <br />or deliver to Port any amount In excess of the daily tolerances or monthly tolerances specified in Table 3. <br />Table 3 <br />and All Gas Products 1.20% 'i <br />j +15 /o <br />1 -10% <br />The Daily Tolerance percentage shall be based on an expected daily volume calculated as follows: [Monthl <br />Volume x 121 + 365 y <br />AVAILABILITY. If for any reason port, fails to take on schedule, delivery of eighty-five percent (85%) of its <br />aggregate monthly minimum loading quantity for in any month, MXE, at Its discretion and without prejudice to <br />any other rights or remedies which Port may have, will be entitled to invoice Fort and Port will pay, as liquidated <br />damages an amount equal to $.0200 multiplied by the difference between the volume of product delivered in the <br />applicable month and ninety percent (90%) of the committed volume for such product (in gallons); provided <br />however the product was reasonably available to Port, <br />Metroplex Energy appreciates your business and looks forward to a continued and mutually -beneficial business <br />relationship.
