RESOLUTION NO. 2014-*R338 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, GRANTING AN <br /> UNDERGROUND EASEMENT TO FLORIDA POWER AND <br /> LIGHT FOR GATEWAY PARK, ATTACHED HERETO AS <br /> EXHIBIT "A"; PROVIDING THE CITY MANAGER AND THE <br /> CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS <br /> NECESSARY TO EFFECTUATE THIS RESOLUTION; <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS,the development of the Gateway Park project includes underground electrical <br /> lines constructed on the property as needed to provide permanent power to the site; and <br /> WHEREAS, this Undergound Easement with accompanying legal description and sketch <br /> provides for the right of Florida Power and Light to own, operate and maintain their infrastructure <br /> on City-owned property; and <br /> WHEREAS, the City Commission wishes to grant the Underground Easement to Florida <br /> Power and Light, attached hereto Exhibit"A". <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA,AS FOLLOWS: <br /> Section 1. Approval to Grant an Undergound Easement. The Underground Easement is hereby <br /> granted to Florida Power and Light for Gateway Park, attached hereto as Exhibit"A". <br /> Section 2. Authorization of City Manager and City Attorney. The City Manager and City <br /> Attorney are hereby authorized to do all things necessary to effectuate this Resolution. <br /> Section 3. Effective Date. This Resolution shall become effective upon adoption. <br /> PASSED AND ADOPTED this 20th day of November 2014. <br /> ,A44, <br /> orman S.
