„ANY 15[E <br />S <br />' A <br />p»• THIRD AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF <br />''•FL° SUNNY ISLES BEACH AND NUNEZ CONSTRUCTION, INC. <br />CONTRACT NO.2024-7081 <br />THIS THIRD AMENDMENT TO THE AGREEMENT between the CITY OF <br />SUNNY ISLES BEACH ("City”) and NUNEZ CONSTRUCTION, INC. whose Federal <br />Employer Identification (FEI) No. is 65-0428890 ("Contractor"), executed this)�day of <br />August 2026, is made a part of the original Agreement between the City and the Contractor, dated <br />July 2, 2024, and amended on March 26, 2025, and March 17, 2026, collectively attached hereto <br />as Exhibit "1" and incorporated herein by reference. The City and Contractor hereby agree as <br />follows: <br />1. CONTRACT TIME. City and Contractor wish to amend Section 3.1.1 of the Agreement, <br />as follows: <br />The City shall notify the Contractor in writing of the date on which the Work shall begin <br />("the Notice to Proceed Date"). The Contractor shall commence site activities on the Notice <br />to Proceed Date, and the Work shall be carried on regularly and without interruption. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein, <br />all terms and conditions of the original Agreement, as amended, shall remain in full force and <br />effect. <br />3. CONFLICTING PROVISIONS.
