5 It must specify the qualification <br />period for your Urban County (three <br />federal -fiscal years covered by the <br />Cooperation Agreement) OR the <br />remaining 1-2 years of your <br />qualification period (for amendments <br />to Cooperation Agreements). It must <br />also state that, by the date in the <br />Urban County Qualification Deadlines <br />published on the HUD Exchange <br />Urban Counties website for the next <br />qualification period, your Urban <br />County will notify the Participating <br />UGLG by letter of its right not to <br />participate. ForAuto-Renewal <br />Cooperation Agreements, it must state <br />the three additional fiscal years that <br />will be covered by the agreement <br />when it auto -renews. <br />6 For regular Cooperation Agreements, <br />it must state that your Urban County <br />and the Participating UGLG will <br />amend the agreement, if necessary, to <br />meet requirements during the Urban <br />County's three-year qualification <br />period. For Auto Renewal <br />Cooperation Agreements, it must state <br />that your Urban County and the <br />Participating UGLG will amend the <br />agreement, if necessary, to meet <br />requirements at any time during the <br />two qualification periods the <br />agreement is in effect (including at <br />the time of requalification). <br />1 Sample Language <br />explanatory[Text i17 italiCS is • not part of <br />the sample language] <br />Example, Auto -Renewal Cooperation Agreement: <br />This Agreement shall remain in effect for the <br />three-year program period of Federal Fiscal Years <br />XXXX, XXXX, and XXXX, and until funds <br />granted and program income received during the <br />three-year program period are expended and the <br />funded activities completed. Neither the County <br />nor the Municipality may terminate, withdraw, or <br />be removed from the program during the three- <br />year program period. <br />This Agreement will renew automatically for <br />participation for one successive three-year Urban <br />County qualification period (Federal Fiscal Years <br />XXXX, XXXX, and XXXX), unless the <br />Municipality or the County provide written notice <br />to the other party that it elects not to participate in <br />a new qualification period. The terminating party <br />shall send a copy of the notice of termination to <br />the HUD field office by the date specified on the <br />HUD Exchange Urban Counties website. The <br />County will notify the Municipality in writing of <br />the Municipality's right to make this election. A <br />copy of the County's notification must be sent to <br />the HUD field office by the date specified on the <br />HUD Exchange Urban Counties website. <br />The Parties agree to adopt amendment(s) to <br />this Agreement as may be required by HUD to <br />meet any new Urban County Qualification <br />requirement(s), when applicable. Failure by <br />either Party to adopt any such amendment, and <br />to submit such amendment to HUD, will void <br />the agreement for such qualification period. <br />45 <br />601 <br />
