IV. APPROVAL <br />A. The Applicant's request for an increase of density from 190 residential units to 264 <br />residential units and a decrease of intensity of Floor Area Ratio (FAR) from 1.089.300 <br />square feet to 1.08 205 square feet is hereby approved. <br />B. The Applicant's request to use of an off -site parking lot, which is located within 300 feet <br />of the development project, to comply with the parking requirements under the Land <br />Development Regulations of the City, is hereby approved <br />V. <br />Conditions to be completed before demolition, below grade or building permits are <br />issued. <br />1. That the plans in the approval be substantially in accordance with that submitted for public <br />hearing. which are entitled "Estates at Acqualina ", prepared by Cohen; Freedman; Encinosa <br />R .Associates Architects. P.A stamped received April 6. 2015 consisting of 25 sheets, <br />landscaping plans consisting of 13 sheets prepared by EDSA Planners and Architects stamped <br />received March 6. 2015 civil plans consisted of 10 sheets prepared by Thomas Checca. P.E. <br />stamped received March 6. 201 and survey consisting of 1 sheet prepared by Fortin. Leavy. <br />Skiles, Inc. stamped received March 6. 2015. Minor revisions to the plan's are permitted to <br />comply with comments provided by the Staff of the City. <br />2. Upon the submittal of an application for building permit, the plans submitted shall meet with <br />the approval of the Community Development Department and be consistent with the specific <br />site plan approved by the Citv Commission. Plans shall include all the required elements of <br />the site plan pursuant to the City's Land Development Regulations. Should revisions in the <br />plans result in a change that would not be considered "minor' in accordance with Section 265- <br />18 of the Citv Code. the Applicant shall be required to obtain another approval of the City <br />Commission. <br />3. That the Applicant shall pay $500.000.00 to the City for the design flexibility allowance <br />provided pursuant to Section 265 -35 D.(4)(d)[ii] of the City Code. That the Applicant <br />provides the City with a non - refundable deposit in the amount of ten percent (10 %) of the <br />design flexibility allowance. The total amount of the deposit is $50,000.00. Failure to pay <br />the required deposit within the three (3) working days of approval of the site plan modification <br />application shall result in an automatic voiding of the City Commission site plan approval. <br />That the Applicant is required to provide a Declaration of Restrictive Covenants in Lieu of <br />Unity of Title pursuant to Section 265 -46 A. (2) of the City Code for the oft - street parking <br />lot. The two lots shall be considered one plot and parcel of land and that said property shall <br />be considered as one plot and parcel of land for parking purposes and other permitted uses <br />under the Zoning Code of the City. The Applicant shall submit a Declaration of Restrictive <br />Covenants in Lieu of Unitv of -fitle in a form acceptable to the City Attomey.
