II. INCORPORATION OF RECITALS <br /> All recitals above are incorporated into the body of this Resolution as if same were fully set forth <br /> herein. <br /> III. FINDINGS AND CONCLUSIONS: <br /> Based on an analysis of the application and the standards for approval for a site plan modification <br /> under the Land Development Regulations. the City Commission makes the following findings and <br /> conclusions: <br /> A. The Applicant's request for site plan modification is consistent with the Comprehensive <br /> Plan and the Land Development Regulations of the City of Sunny Isles Beach. <br /> IV. APPROVAL <br /> A. The Applicant's request to reduce the density of Phase I I of the project from 329 residential <br /> units to 320 residential units is hereby approved. <br /> B. The Applicant's request to modify the Bay-walk easement width from a minimum width <br /> of 7 feet, which was previously approved, to a minimum width of 4 feet in certain areas as <br /> described in the approved modified plans, is hereby approved. <br /> C. The Applicant's request for a one (1) year extension to obtain a building permit from <br /> October 17, 2015, the date of expiration of the previously approved zoning. approval, is <br /> hereby approved. <br /> V. CONDITIONS <br /> Conditions to be completed before demolition, below grade or building permits are <br /> issued. <br /> 1. That the plans in the approval be substantially in accordance with that submitted for <br /> public hearing, which are entitled "Phase II - Condominium Towers IV & V, Phase III <br /> — Office Building', prepared by axioma3_ Inc. consisting of 9 sheets last revised March <br /> 24, 2015. Minor revisions to the plans are permitted to comply with comments provided <br /> by Staff of the City. <br /> 2. Upon the submittal of an application for building permit, the plans submitted shall meet <br /> with the approval of the Community Development Department and be consistent with <br /> the specific site plan approved by the City Commission. Plans shall include all the <br /> required elements of the site plan pursuant to the City's Land Development <br /> Regulations. Should revisions in the plans result in a change that would not be considered <br /> "minor" in accordance with Section 265-18 of the City Code; the Applicant shall be <br /> required to obtain another approval of the City Commission. <br /> I5-Z-1 St. Tropez on the Bay: Phases II and III 3 <br />
