RESOLUTION NO. 2015- 24 IC) <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, DIRECTING THE ZONING <br /> ADMINISTRATOR TO ADMINISTRATIVELY CLOSE OUT A <br /> PRIVATE TRANSFER OF DEVELOPMENT RIGHTS ("TDRs") <br /> BANK ACCOUNT OF DEZER DEVELOPMENT LLC; AND TO <br /> DEPOSIT UNASSIGNED TDRs TO THE CITY BANK ACCOUNT <br /> IN THE AMOUNT OF THIRTY THREE THOUSAND SEVEN <br /> HUNDRED FIFTY (33,750) TRANSFER OF DEVELOPMENT <br /> RIGHTS ("TDRS") AND SIXTEEN (16) DWELLING UNITS ; <br /> PROVIDING THE CITY MANAGER AND CITY ATTORNEY <br /> WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO <br /> EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City Commission directed the Zoning Administrator to create a Private <br /> Transfer of Development Rights ("TDRs") Bank account for Dezer Development, LLC ("Dezer") <br /> pursuant to Resolution No. 2013-2130 adopted on October 17, 2013 as part of a site plan approval <br /> pursuant to Zoning Resolution No. 13-Z-138 adopted on October 17, 2013; and <br /> WHEREAS,the City Commission wishes to administratively close out the Dezer's Private <br /> TDR Bank account of 33,750 square feet of floor area and sixteen (16) dwelling units; and <br /> WHEREAS, the City Commission wishes to deposit the unassigned TDRs in the amount <br /> of 33,750 square feet of floor area and sixteen(16)dwelling units into the City TDRs bank account. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are <br /> incorporated herein by reference as if they are fully set forth herein. <br /> Section 2. Directing the Zoning Administrator to administratively close out a Private TDR <br /> Bank account. The City Commission hereby directs the Zoning Administrator to administratively <br /> close out a private Transfer of Development Rights ("TDRs") Bank account for Dezer <br /> Development, LLC. <br /> Section 3. Directing the Zoning Administrator to Deposit the TDRs. The City Commission <br /> hereby directs the Zoning Administrator to deposit into the City's TDR Bank the unassigned TDRs <br /> in the amount of 33,750 square feet of floor area and sixteen (16) dwelling units. <br /> Section 4. Authority of the City Manager and City Attorney. The City Manager and City <br /> Attorney are hereby authorized to do all things necessary to effectuate this Resolution. <br /> Section 5.
