Plaza of the Americas <br /> Acquisition of Property for Pedestrian Overpass Bridge for Gateway Park <br /> Owner of Unit 414 in Building 1, Plaza of the Americas <br /> Dear Ana: <br /> It was a pleasure speaking with you yesterday regarding the acquisition of a portion of <br /> the common area of the Plaza of the Americas by the City of Sunny Isles'Beach ("City") for its <br /> Pedestrian Overpass Bridge for the Gateway Park ("Project") . Please allow this letter to serve to <br /> confirm the settlement reached with Hans Ottinot, City Attorney, and myself regarding your <br /> objections to the proposed acquisition and/or appraised value of the property. <br /> The terms of the settlement are as follows: <br /> 1. Compensation: You will receive from the City the sum of SEVEN THOUSAND FIVE <br /> HUNDRED DOLLARS ($7,500.00) in full settlement of all claims'for compensation arising <br /> from of in any way related to the taking and/or acquisition of the common area of the Plaza of <br /> the Americas ("Property"), which is described on Exhibit A attached hereto, within thirty days <br /> (30) of receipt by the City of the executed letter. <br /> 2. Unit Owner's Interest: In exchange for receipt of the compensation set forth in <br /> Paragraph 1 above, you (a) withdraw your objections to the City's proposed acquisition and <br /> appraised value of the Property; (b) convey your interest as a unit owner in the Property and (c) <br /> • <br /> disclaim all rights you have under Florida Law with regard to the condemnation of the Property. <br /> 3. Noise: The City will use its best efforts to remedy any complaints by you or your <br /> tenant, which said complaints are to be made to the City Manager or his designee, regarding <br /> noise from the elevator of the Pedestrian Overpass Bridge <br /> EXHIBIT "A" <br />
