RESOLUTION NO. 2015- 2142.9 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE <br /> CREATION OF A TRANSFER OF DEVELOPMENT RIGHTS <br /> ("TDRs") SUB-ACCOUNT IN THE AMOUNT OF NINETEEN <br /> THOUSAND TWO HUNDRED EIGHTY-SEVEN (19,287) SQUARE <br /> FEET OF FLOOR AREA AND NINE (9) DWELLING UNITS IN <br /> FAVOR OF ST. TROPEZ BEACH DEVELOPERS, LLC. ET AL.; <br /> DIRECTING THE ZONING ADMINISTRATOR OR THEIR <br /> DESIGNEE TO BANK THE TDRs IN A PRIVATE TDRs SUB- <br /> ACCOUNT WITH CERTAIN CONDITIONS; PROVIDING THE <br /> CITY MANAGER AND THE CITY ATTORNEY WITH THE <br /> AUTHORITY TO DO ALL THINGS NECESSARY TO <br /> EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, by Zoning Resolution No. 15-Z-151 adopted on April 16, 2015 the City <br /> Commission approved the site plan modification submitted by St. Tropez Beach Developers, LLC <br /> et. al. ("Applicant") for a reduction of dwelling units; and <br /> WHEREAS, the Applicant is requesting a credit for the unused TDRs in the amount of <br /> Nineteen Thousand Two Hundred Eighty-Seven (19,287) square feet of Floor Area Ratio (FAR) <br /> and nine (9) dwelling units; and <br /> WHEREAS, the Applicant has already paid in full the approved TDRs under Building <br /> Permit No. B2015-108; and <br /> WHEREAS, the City Commission wishes to approve a private TDRs sub-account in favor <br /> of St. Tropez Beach Developers, LLC. et al. with certain conditions and in accordance with Section <br /> 265-23 of the Code of Ordinances of the City of Sunny Isles Beach. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are <br /> incorporated herein by reference as if they are fully set forth herein. <br /> Section 2. Approving the Creation of Private TDRs sub-account. Pursuant to Section 265-23 of <br /> the City Code the City Commission hereby authorizes the creation of a Private TDRs sub-account <br /> in the amount of 19,287 square feet of floor area ratio (FAR) and 9 dwelling units to St. Tropez <br /> Beach Developers, LLC et. al. <br /> R2015-TDRs St.Tropez Dev, LLC.
