ORDINANCE NO. 2015 - 14 55 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, TO AMEND SECTION 265- 46(17) OF THE CITY CODE TO CLARIFY THE SIZE REQUIREMENT FOR MECHANICAL PARKING STALLS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND PROVIDING FOR AN • EFFECTIVE DATE. WHEREAS, the Mechanical Parking Regulations in the City Code do not provide specific size requirements for mechanical parking stalls; and WHEREAS, Section 265-46(17)of the City Code is required to be amended to clarify that mechanical parking stalls shall be the same size as non-mechanical parking stalls. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Amended. Section 265-46(17) of the City Code is amended to reads as follows: (c) Mechanical Parking Lifts must also satisfy the following conditions: [1] 121 The size of the surface parking stalls for mechanical lifts shall be 9 feet in width and 18 feet in length for all residential and commercial developments. Section 2. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 3. Inclusion In The Code. It is the intention of the City Commission, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word, as required. Section 4. Repealer. All ordinances or part of ordinances in conflict herewith be and the same are hereby repealed Section 5. Effective Date.
