REASONS The purpose of Chapter 172 ("Human Relations") of the Code of Ordinances of the City of Sunny Isles Beach is to recognize the changing needs of society and to treat all persons fairly and equitably. Currently, there are very few legal non-discrimination protections afforded to persons based on gender identity or gender expression under federal or state law. Notwithstanding this lack of inclusion in anti-discrimination laws, there are currently over twenty five (25) Florida counties and cities, including Miami-Dade County and Miami Beach, that extend legal protections to persons based on gender identity or gender expression, which includes transgendered individuals. The City wishes to strengthen its anti-discrimination protections to prohibit discrimination against persons based on gender identity or gender expression. More precisely, the City wishes to prohibit discrimination against any person, based on their gender identity or gender expression, in providing services. programs. or activities offered by the City. Additionally, the City wishes to prohibit the discrimination against any person, based on their gender identity or gender expression, in the conditions of employment with the City. Notwithstanding the foregoing, the City reserves the right to provide services, programs, or activities, and administer its employment practices, based on bonafide, non-discriminatory business decisions. This proposed Ordinance was requested by Commissioner Jennifer Levin.
