Currently, there are very few legal non-discrimination protections afforded to persons <br /> based on gender identity or gender expression under federal or state law. Notwithstanding this <br /> lack of inclusion in anti-discrimination laws, there are currently over twenty five (25) Florida <br /> counties and cities, including Miami-Dade County and Miami Beach, that extend legal <br /> protections to persons based on gender identity or gender expression, which includes <br /> transgendered individuals. <br /> The City wishes to strengthen its anti-discrimination protections to prohibit discrimination <br /> against persons based on gender identity or gender expression. More precisely, the City wishes <br /> to prohibit discrimination against any person, based on their gender identity or gender <br /> expression, in providing services. programs. or activities offered by the City. Additionally, the <br /> City wishes to prohibit the discrimination against any person, based on their gender identity or <br /> gender expression, in the conditions of employment with the City. Notwithstanding the <br /> foregoing, the City reserves the right to provide services, programs, or activities, and administer <br /> its employment practices, based on bonafide, non-discriminatory business decisions. <br /> This proposed Ordinance was requested by Commissioner Jennifer Levin. <br />
