(2) That the Applicant shall submit a site plan application for the Varadero site no later than September 4, 2015. If the site plan application is not submitted, the sales center shall be removed within 30 days. (3) A bond shall be posted by the applicant for the amount $20,000 that would be necessary if the City were placed in the position of having to remove said temporary sales center or trailer. (4) Removal of the sales center must comply with all City and County requirements. Removal shall occur no later than 30 days after Temporary Certificate of Occupancy is obtained for the development project on the Varadero site, unless a site plan approval for a different project is approved for the subject property. (5) That the Applicant comply with all conditions and permit requirements of the Department of Permitting, Environment and Regulatory Affairs (RER), the Miami-Dade County Fire Department(MDFD), Water and Sewer Department, Department of Environmental Protection (DEP), Florida Department of Transportation (FDOT). (6) If the Applicant does not obtain a building permit within three (3) months of the approval to construct the sales center, the approval shall be deemed null and void. (7) That the proposed art-work statue, if approved by the City Commission, shall be installed at a location designated by the City Manager or his designee. Notwithstanding the foregoing, the City has the absolute discretion to direct the removal at Applicant's expense the art-work statute if it becomes a distraction to drivers on Collins Avenue. (8) That the Applicant shall maintain the vacant area of the property clean and free of any debris. The vacant area shall provide an erosion control sediment fence and the area shall not be used for any purpose beyond the proposed use permitted in this approval. (9) That the Applicant shall submit a staging plan before commencing any construction activity. The staging plan shall provide a schedule of activities such as, parking arrangements, lane closures, sidewalk closures, and any other required activity that may provoke an impact at the surrounding areas to the site. The staging plan shall be approved administratively by the City Manager or designee. (10) That the construction fence and side walk shall be maintained in clean and in good condition at all times.
