11. I recommended that Southeastern be awarded the bid because <br /> Southeastern is the most responsible bidder with the lowest price. Based on the <br /> information that I reviewed and my experience, I certainly believe that Southeastern has <br /> the capacity to complete an extremely complex project. <br /> 12. Prior to recommending the bid award, I carefully considered the various <br /> factors outlined in Section 62-8 of the City Code pertaining to bid awards. That section <br /> mandates that contracts shall be awarded by the City Manager to the lowest <br /> responsible and responsive bidder. The factors that were considered, in addition to <br /> price, included 1) the capacity, ability and skill of the provider to perform the contract; 2) <br /> whether the performer can perform the contract within the time specified without delay <br /> or interference; 3) the character, integrity, reputation, judgment, experience and <br /> efficiency of the provider; 4) professional licensure requirements; 5) quality of <br /> performance of previous contracts; 6) previous and existing compliance by the provider <br /> with laws and ordinances relating to the contract; and 7) ability of the provider regarding <br /> future maintenance and service for the use of the subject of the contract. <br /> 13. Utilizing the criteria mandated by Section 62-8 of the City Code, I <br /> recommended that the bid be awarded to the lowest responsible and responsive bidder, <br /> i.e. Southeastern. The protester, Tran Construction, Inc. ("Tran") failed to satisfy all the <br /> criteria set forth in Section 62-8. More specifically, Tran failed to demonstrate fully that <br /> it had the capacity and skill to perform the job. <br /> 14. On or about February 21, 2008, I made my recommendation to the City <br /> Commission, which approved my recommendation. Exhibit "A", attached hereto and <br /> made a part hereof, is a true and correct copy of the memorandum I drafted regarding <br />
