analysis has to be prepared to support the designation, and his recommendation is to hire a <br /> consultant to do the analysis to make sure we have a good case. <br /> Michelle D'Arbelles said that we have to go through a legal process through the State, Section <br /> 4F, and noted legal implications of an owner regarding remodeling. City Attorney Ottinot said we <br /> can designate property without going through the State, we just have to justify it. Ms. D'Arbelles <br /> asked if they wanted to do remodeling on the house do they have to go before the Board? <br /> Chairperson Del Monico and City Attorney Ottinot said yes. Chairperson Del Monico asked the <br /> City Attorney if we are in the process of designating a property does that put a stop on them <br /> trying to get a permit to tear down the building, and City Attorney Ottinot said that they will <br /> probably try to stop this process first because if we designate it as historic that is going to limit <br /> them, so any property owner would come here to see if they can stop the process, and the <br /> decision is within the Board's discretion to say yes or no. <br /> Chairperson Del Monico said that we have two properties that are standing right now that we may <br /> designate as historic. Mr. Schulman said that he feels the most likely in our favor is the Golden <br /> Strand because it is a "time share" and has already created a file for it! He said he has all the <br /> papers including when it was built in 1946 and the site legal description, the ownership, the <br /> picture of the area, and the registered agents. City Attorney Ottinot said that a "time share" is <br /> individual unit owners, and notice would have to go to all owners. He said that there are a lot of <br /> equities that favors designation of the Ocean Palm. Ms. D'Arbelles asked why are we going to <br /> designate something that is going to be torn down? Mr. Schulman said there is a greater <br /> possibility that the Golden Strand will not be torn down as it is a time share. Chairperson Del <br /> Monico said she feels that what Michelle is asking is if it is going to be torn down why preserve it. <br /> Vice Mayor Thaler said that there are many ways of preservation, such as creating an historic <br /> front. <br /> Casey Gabor suggested designating the "Sahara" as it is one of the first motels and famous <br /> people have stayed there. Mr. Schulman said it is a condominium now owned by the Dezers and <br /> they may tear it down. Mr. Schulman said he would find out ownership and report back at the <br /> next meeting. Phillip Chernoff mentioned the Lagoon but that it was mostly destroyed by <br /> Hurricane Wilma, and Vice Mayor Thaler suggested to go there and see if there is anything left to <br /> designate. Mr. Schulman said he would take a picture and report back at the next meeting. Mr. <br /> Chernoff noted that the Rascal House Sign was destroyed by the Hurricane as well. <br /> Chairperson Del Monico asked if there were any homes that we wanted to designate and Mr. <br /> Chernoff noted that the Board had discussed Ellen Wynne's home. He said they made a replica <br /> of her home, and Vice Mayor Thaler said that Miami Beach wanted to make it historic because it <br /> was the oldest that this particular architect designed. Mr. Schulman said he will take a picture <br /> and bring it to the next Board meeting. He said that he wouldn't recommend designating a home <br /> because of its architect but rather for its architecture. Trina Duluc asked about Bnai Zion <br /> Temple, and Commissioner Goodman said that St. Mary Magdalen, Catholic Church just <br /> celebrated their 59th Anniversary. Mr. Chernoff said that you can also designate historically not <br /> only by the architect but by the person who lived there. Vice Mayor Thaler said that Mark Twain <br /> had about six different homes and they have all been designated historic. <br /> Casey Gabor suggested placing a US flag near the plaque but Chairperson Del Monico said that <br /> is Federal.
