Public Hearing A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Providing for the Abandonment and Vacation of That Portion of North Bay Road From 170th Street to 172"d Street as More Fully Described in Exhibit "A" and Providing for the Dedication of That Portion of Property Immediately Adjacent to North Bay Road More Fully Described in Exhibit "B"; Providing That Vacation and Abandonment of the Portion of the Road Described in Exhibit "A" be Held in Escrow Until the Applicant Satisfies Certain Enumerated Conditions and Constructs and Dedicates That Certain Property Described in Exhibit `B" in Accordance with Said Conditions for Public Use as a Public Right-of-Way; Providing for the City Manager and City Attorney to Do All Things Necessary to Effectuate this Transaction; and Providing for an Effective Date. Action: City Clerk Brown-Morilla read the title and City Attorney Dannheisser presented her report, and indicated that she had given a copy of an agreement to Brain Adler, Esq., representing the applicant. She said the applicant must agree to execute the agreement, and Mr.Adler said that the applicant will execute the agreement in substantially the same form. [City Clerk's note: the agreement was submitted into the record.] Public Speakers: Brian Adler, Esq.; Gerry Goodman; Phillip Chemoff Commissioner Iglesias moved and Commissioner Morrow seconded a motion to approve the resolution as amended, with the requirement that the applicant must sign the agreement in substantially the same form. Resolution No. 2001-321 was adopted by a voice vote of 5-0 in favor. 9B. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, Authorizing the City Manager to Apply For and Accept a Grant from the Department of Community Affairs Waterfronts Florida Program to,Among Other Things,Assist in the Revitalization Effort for the Sunny Isles Boulevard Waterfront Area;Authorizing the City Manager or His Designee to Take Any Action Necessary with Respect to the Obtaining and Distribution of Grant Monies as Appropriate Without Further Approval of This Commission; Providing for an Effective Date.
