RESOLUTIONS <br /> 9A. Public Hearing <br /> A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, <br /> Providing for the Abandonment and Vacation of That Portion of North Bay Road <br /> From 170th Street to 172"d Street as More Fully Described in Exhibit "A" and <br /> Providing for the Dedication of That Portion of Property Immediately Adjacent to <br /> North Bay Road More Fully Described in Exhibit "B"; Providing That Vacation and <br /> Abandonment of the Portion of the Road Described in Exhibit "A" be Held in Escrow <br /> Until the Applicant Satisfies Certain Enumerated Conditions and Constructs and <br /> Dedicates That Certain Property Described in Exhibit `B" in Accordance with Said <br /> Conditions for Public Use as a Public Right-of-Way; Providing for the City Manager and <br /> City Attorney to Do All Things Necessary to Effectuate this Transaction; and Providing <br /> for an Effective Date. <br /> Action: City Clerk Brown-Morilla read the title and City Attorney Dannheisser presented <br /> her report, and indicated that she had given a copy of an agreement to Brain Adler, Esq., <br /> representing the applicant. She said the applicant must agree to execute the agreement, <br /> and Mr.Adler said that the applicant will execute the agreement in substantially the same <br /> form. [City Clerk's note: the agreement was submitted into the record.] <br /> Public Speakers: Brian Adler, Esq.; Gerry Goodman; Phillip Chemoff <br /> Commissioner Iglesias moved and Commissioner Morrow seconded a motion to approve <br /> the resolution as amended, with the requirement that the applicant must sign the <br /> agreement in substantially the same form. Resolution No. 2001-321 was adopted by <br /> a voice vote of 5-0 in favor. <br /> 9B. A Resolution of the City Commission of the City of Sunny Isles Beach, Florida, <br /> Authorizing the City Manager to Apply For and Accept a Grant from the Department <br /> of Community Affairs Waterfronts Florida Program to,Among Other Things,Assist <br /> in the Revitalization Effort for the Sunny Isles Boulevard Waterfront Area;Authorizing <br /> the City Manager or His Designee to Take Any Action Necessary with Respect to the <br /> Obtaining and Distribution of Grant Monies as Appropriate Without Further Approval of <br /> This Commission; Providing for an Effective Date. <br /> Action: City Clerk Brown-Morilla read the title and Community Planning & <br /> Development Director Marla Dumas presented her report. <br /> Public Speakers: none <br /> 4 <br />
