and requirements for the zoning district in which it is located, and that the use or structure <br /> conforms to the plans and specifications for which the building permit was issued. <br /> F. Revocation and suspension. <br /> I. All certificates of occupancy including a temporary certificates issued under this <br /> Section may be revoked or suspended by the City's Building Official in accordance <br /> with Section 111.5 of the Florida Building Code, upon the following grounds: <br /> Cu The certificate of occupancy was issued by mistake of law or fact. <br /> (ii) The certificate of occupancy was issued upon a misrepresentation by the <br /> applicant. <br /> (iii) The certificate of occupancy is for a land use or occupancy type that violates <br /> any Ordinance of the City, or State or Federal law, rule or regulation. <br /> (iv) The work was not performed in accordance with the City of Sunny Isles <br /> Beach Code of Ordinances. <br /> (v) Wherever it is determined that the building or structure of portion thereof is <br /> in violation of the Florida Building Code, as amended,the City of Sunny Isles <br /> Beach Code of Ordinances, the Miami Dade County Code of Ordinances, or <br /> any state or federal statute, rule, code or regulation applicable thereto. <br /> II. It shall be unlawful for the owner or any other person with knowledge of such <br /> revocation or suspension to occupy the building unless said certificate of occupancy <br /> is reinstated by the City's Building Official or a new certificate of occupancy is <br /> issued. <br /> Section 3. Severability. The provisions of this Ordinance are declared to be severable and if <br /> any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br /> or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, <br /> clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent <br /> that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> Section 4. Inclusion In The Code. It is the intention of the City Commission, and it is hereby <br /> ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny <br /> Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to <br /> accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other <br /> appropriate word, as required. <br /> Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the same <br /> are hereby repealed. <br /> Words added underlined,words stricken deleted(ed) <br />
