(305)949.3113 Fax <br /> MEMORANDUM <br /> TO: The Honorable Mayor and City Commission <br /> FROM: Hans Ottinot,City Attorney <br /> DATE: 11/19/2015 <br /> RE: Ordinance amending Section 265-21 of the City Code <br /> RECOMMENDATION: <br /> It is recommended that the City Commission approve the proposed <br /> Ordinance amending Section 265-21 of the City Code. <br /> REASONS: <br /> • <br /> The purpose of Section 265-21 ("Certificates of Occupancy") of the <br /> Code of Ordinances of the City of Sunny Isles Beach ("City Code") is <br /> for development review standards for Certificates of Occupancy for <br /> buildings and structures located in the City. More precisely, Section <br /> 265-21 of the City Code provides that a Certificate of Occupancy shall <br /> be issued only after the premises have been inspected and found to <br /> be in compliance with the Florida Building Code and all applicable <br /> standards and requirements for the zoning district in which the building <br /> or structure is located. <br /> The City desires to amend Section 265-21 of the City Code to mirror <br /> the authority that the Building Official has under the Florida Building <br /> Code regarding the revocation of a Temporary Certificate of <br /> Occupancy and Certificate of Occupancy. Grounds for revocation or <br /> suspension include a determination that a building or structure, or <br /> portion thereof, is in violation of the Florida Building Code, the City <br /> Code, Miami-Dade County Code, or any state or federal statute, rule, <br /> code, or regulation applicable thereto. <br /> This Ordinance was requested by the Building Official via the City <br /> Manager's Office. <br /> ATTACHMENTS: <br /> Description <br /> LPA Resolution <br /> Ordinance <br /> Notice of 2nd Rdg LPA Herald <br /> Item Number:9.B. <br /> • <br /> } <br /> http://sunnyisles.novusagenda.com/AgendaWeb/CoverSheet.aspx?ItemID=1797 11/12/2015 <br />
