(305)949.3113 Fax MEMORANDUM TO: The Honorable Mayor and City Commission FROM: Hans Ottinot,City Attorney DATE: 11/19/2015 RE: Ordinance amending Section 265-21 of the City Code RECOMMENDATION: It is recommended that the City Commission approve the proposed Ordinance amending Section 265-21 of the City Code. REASONS: • The purpose of Section 265-21 ("Certificates of Occupancy") of the Code of Ordinances of the City of Sunny Isles Beach ("City Code") is for development review standards for Certificates of Occupancy for buildings and structures located in the City. More precisely, Section 265-21 of the City Code provides that a Certificate of Occupancy shall be issued only after the premises have been inspected and found to be in compliance with the Florida Building Code and all applicable standards and requirements for the zoning district in which the building or structure is located. The City desires to amend Section 265-21 of the City Code to mirror the authority that the Building Official has under the Florida Building Code regarding the revocation of a Temporary Certificate of Occupancy and Certificate of Occupancy. Grounds for revocation or suspension include a determination that a building or structure, or portion thereof, is in violation of the Florida Building Code, the City Code, Miami-Dade County Code, or any state or federal statute, rule, code, or regulation applicable thereto. This Ordinance was requested by the Building Official via the City Manager's Office.
