Summary Minutes: City Commission Meeting November 13,2003 City of Sunny Isles Beach,Florida <br /> Judith Burke, Esq., representing Fortune Beach, LLC, said that they have no objection if <br /> they are asked to put in the bathroom facility with the showers in the public park, and if <br /> the Commission would also like them to put in showers and a fountain, and a bench in the <br /> public park, they would be happy to do so. Vice Mayor Goodman asked who will be <br /> maintaining the property after it is built, and Ms. Burke said that if they end up building <br /> the facilities on their property,they will maintain them, in the event the City asks them to <br /> build the bathrooms in the public park,the City will maintain the bathrooms as part of the <br /> public park. Commissioner Thaler asked who is responsible in maintaining the bathrooms <br /> and restrooms, and assuming that they are not maintained properly, who has the right to <br /> repair and maintain the showers and bathrooms, and Ms. Burke said that there is a <br /> Declaration which will be recorded in the public records giving the City the right to <br /> inspect and if it is not maintained, the City will issue a notice of violation, and by that <br /> time the Association will be required to do so. <br /> Commissioner Thaler asked for clarification on what we are voting on tonight, and Ms. <br /> Burke noted that the Commission is only voting on the price of the appraisal, as the <br /> resolution was adopted on September 18, 2003. City Attorney Dannheisser said that we <br /> can avoid this in the future by not taking a vote until the resolution is finalized. <br /> Mayor Edelcup noted that sometime in the near future we can have something like a <br /> Mayor's Advisory Council that will bring the people and the developers together within <br /> the same forum and give both sides an opportunity to be heard. <br /> On September 18, 2003, Commissioner Kauffman moved and Commissioner Iglesias <br /> seconded a motion for approval, subject to staff conditions, and put in bathrooms <br /> and showers if possible, and bring back the Resolution to the City Commission for <br /> final approval.
