ORDINANCE NO. 2015- y l , <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITYOF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 183-1 <br /> OF THE CODE OF ORDINANCES OF SUNNY ISLES BEACH, <br /> ENTITLED "LICENSES AND PERMITS" TO PROVIDE FOR A <br /> PERMIT FOR BEACH ACCESS CLOSURE; PROVIDING FOR <br /> SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; <br /> PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the purpose of Chapter 183 of the City Code of Sunny Isles Beach is to <br /> provide certain minimum requirements in all matters relating to the issuance, revocation, and <br /> suspension of permits; and <br /> WHEREAS, permits are required to show compliance with regulations under the Florida <br /> Building Code, the City Code, as well as to promote the health, safety and general welfare of City <br /> residents and visitors alike; and <br /> WHEREAS, the City wishes confirm that a permit is required prior to a closure of a <br /> Beach Access to perform work near or on the access property. <br /> WHEREAS, the City Commission wishes to amend Section 183-1 to include the <br /> requirement of a permit to close a beach access. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof. <br /> Section 2. Amendment. Section 183.1 of the City Code is amended to read as follows: <br /> § 183-1 Permits required. <br /> A. Building permit required. Any owner or authorized agent who intends to <br /> construct, enlarge, alter, repair, move, demolish or change a building, structure, <br /> or part thereof, or conduct work in the public rights-of-way or public easement, <br /> or use, clear, fill, excavate, move, pave, grade or otherwise alter land, water or <br /> beach sand, shall first be required to obtain the applicable building permit from <br /> the City prior to commencing any such work. <br /> Words added underlined.words stricken deleted(ed) Paae 1 of 3 <br />
