<br />00801 - 1/1 <br /> SECTION 00801 - LOCAL REQUIREMENTS <br /> <br /> <br />PART 1 -- GENERAL <br /> <br />These local requirements make additions to the Contract Documents which are required by <br />state and local regulations. <br /> <br />A. Public Entity Crimes: Pursuant to the requirements of Section 287.133, Florida <br />Statues, pertaining to the sworn statement on Public Entity Crimes and the Convicted <br />Vendor List, all Bidders shall submit a signed and notarized statement with their Bid on <br />the form provided in Section 00300, "Sworn Statement Pursuant to Section <br />287.133(3)(a), FLORIDA STATUTES on Public Entity Crimes." <br /> <br />B. Florida Trench Safety Act: The Bidders attention is directed to the enactment of the <br />Florida Trench Safety Act, which incorporates OSHA Standards 29 CFR 1926.650, <br />Subpart P, as the state's trench excavation safety standards. The Bidder shall list <br />separately on the form provided in Section 00300 - Trench Safety Act Compliance <br />Statement the cost of compliance with these standards. The Bidder shall determine if <br />special shoring requirements are needed. Special shoring shall be identified and <br />included in the cost quoted in the "Trench Safety Act Compliance Statement". The <br />successful Bidder is fully responsible for the design of the trench safety system and the <br />compliance with the applicable standards for the Project. <br /> <br />C. Anti-Kickback Affidavit: All Bidders shall submit a signed and notarized Affidavit with <br />their Bid on the form provided in Section 00300, "Anti-Kickback Affidavit". <br /> <br />D. Indemnification: Pursuant to Section 725.06 of the Florida Statutes, the CONTRACTOR <br />hereby acknowledges receipt and the adequacy of the specific consideration in the <br />amount of one hundred ($100) which sum is included in the Total Bid Price, as payment <br />from the OWNER to the CONTRACTOR for the indemnification given by the <br />CONTRACTOR to the OWNER and ENGINEER under Section 00700, "General <br />Conditions", Paragraph 6.13. <br /> <br />E. Time is of the Essence for This Contract: Should the Contractor fail to complete the <br />Contract by the contract completion date, as amended by any approved Change Orders, <br />the Contractor will be subject to the liquidated damages as set forth elsewhere in this <br />contract. In addition to the imposition of liquidated damages, the Owner will not process <br />any partial payment request, nor make any partial payments to the contractor for such <br />beyond the contract completion date (e.g., the only payment that will be made beyond the <br />contract completion date will be a final payment once all the work has been completed <br />and accepted by the owner). <br /> <br /> <br /> - END OF SECTION - <br />
