I 1 <br /> LPA RESOLUTION NO. 2016 - _b3 <br /> A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE CITY OF <br /> SUNNY ISLES BEACH EAR-BASED TEXTURAL AMENDMENTS TO <br /> THE CITY OF SUNNY ISLES BEACH'S COMPREHENSIVE MASTER <br /> PLAN, AND THE REQUIRED TRANSMITTAL OF THE REPORT WITH <br /> AMENDMENTS IN ACCORDANCE WITH SECTION 163.3191, <br /> FLORIDA STATUTES; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, the City of Sunny Isles Beach, Florida was incorporated on June 17, 1997; <br /> and <br /> WHEREAS, pursuant to the provisions of the Local Government Comprehensive Planning <br /> and Land Development Regulation Act, on October 5, 2000, the City of Sunny Isles Beach <br /> adopted its Comprehensive Plan; and <br /> WHEREAS, on September 22, 2005, the City Commission, acting in its capacity as the <br /> City's Local Planning Agency determined that it was in the best interest of the City and its <br /> residents to recommend approval of the Resolution adopting the EAR for transmittal to the State <br /> Department of Community Affairs; and. <br /> WHEREAS, Section 163.3191, Florida Statutes, directs local governments to periodically <br /> assess the success or failure of the adopted plan to adequately address changing conditions and <br /> state policies and rules; and <br /> WHEREAS, the City had completed its Evaluation and Notification Letter pursuant to the <br /> requirements of Section 163.3191(2), Florida Statutes, and transmitted the Evaluation and <br /> Appraisal Notification Letter to the Department of Economic Opportunity on December 1, 2014, <br /> who acknowledged receipt of the Letter and the City's intent to prepare Comprehensive Plan <br /> amendments based on the Letter; and <br /> WHEREAS, the City held and advertised town hall meetings with residents, business <br /> owners to provide for public participation in the process in accordance with Chapter 163, Florida <br /> Statutes, and the City prepared an Evaluation and Appraisal Report of its Comprehensive Plan in <br /> order to update baseline data and analysis, and identify additional amendments that may be needed <br /> to address community-specific needs and challenges; and <br /> WHEREAS, the City Commission serves as the Local Planning Agency ("LPA"), and <br /> whereas the LPA is required to review the EAR-Based Amendments; and <br /> WHEREAS, on January 21, 2016 via LPA Resolution No. 2016-100 the LPA approved the <br /> EAR-Based Textural Amendments to the Comprehensive Master Plan at the first hearing for <br /> transmittal to the Florida Department of Economic Opportunity; and <br /> LPA R2016-Transmittal of Proposed EAR Amendments to DEO <br />
