Summary Minutes:Regular City Commission Meeting May 19,2016 City of Sunny Isles Beach,Florida <br /> 163.3191,Florida Statutes; Providing for Severability;Providing for Repealer;Providing for <br /> Inclusion in the Code; Providing for an Effective Date. <br /> (First Reading 01/21/16) <br /> Action: City Clerk Hines read the title, and Planning and Zoning Administrator Claudia <br /> Hasbun reported that Jerry Bell of Bell David Planning Group is here tonight to make the <br /> presentation. <br /> Public Speakers: Jerry Bell <br /> Jerry Bell said tonight at second reading is the adoption of the Evaluation and Appraisal <br /> Report(EAR)and Report-Based Textural Amendments to the City's Comprehensive Master <br /> Plan. He gave a PowerPoint presentation, and said after first reading they transmitted it to <br /> the State and all the review agencies and we received one objection and a series of <br /> comments. The objection was minor, in the report we mentioned we needed to update the <br /> Future Land Use Plan to include the date of 2030, and they actually wanted to see the map <br /> which we produced, and included in the Report. We got a comment that they asked us also <br /> to look at updating the Coastal High Hazard Area Map in the Plan, there was a new model <br /> that changed those areas and so we did update that map. Another comment and this <br /> happened in 2015 the State came up with some new requirements for cities that have a <br /> Coastal Management Element to include Policies regarding Peril of Flood, in response we <br /> did a new Objection 9, New Policies 9A through 9E in the Plan. This is really looking at <br /> peril of flood in areas of the City that might be vulnerable. The other comment was minor <br /> and it had to do with language in the existing Comprehensive Plan where we had a policy <br /> that addressed Regulation of Housing by Tenure which is not something normally addressed, <br /> but we had to clarify that,and so we deleted the ambiguous language. We had a conversation <br /> on the phone with the State Reviewer who had some suggestions for changes that were very <br /> minor throughout the document. The ones we agreed with we made and those are <br /> highlighted in the document. <br /> Mr. Bell said after it is adopted tonight we will transmit it back to the State and they will <br /> have 45 days to get us the Notice of Intent and at that point we will publish the new <br /> Comprehensive Plan with all of these changes. The Plan will then be implemented through <br /> changes to the LDRs, grants, and other activities throughout the years. <br /> Commissioner Goldman moved and Vice Mayor Gatto seconded a motion to approve the <br /> Ordinance on second reading. Ordinance No.2016-480 was adopted by a roll call vote <br /> of 5-0 in favor. <br /> Vote: Commissioner Aelion yes <br /> Commissioner Goldman yes <br /> Commissioner Levin yes <br /> Vice Mayor Gatto yes <br /> Mayor Scholl yes <br /> 6 <br />
