<br />RESOLUTION NO. 03-Z-79 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING THE ZONING <br />APPLICA TION SUBMITTED BY FORTUNE BEACH L.L.C., FOR A <br />TEMPORARY SALES OFFICE BUILDING AND OTHER VARIANCES <br />RELATING THERETO, SUBJECT TO CERTAIN CONDITIONS; <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />I. RECITALS. <br /> <br />WHEREAS, on November 11, 2003, Fortune Beach L.L.C., submitted an application to <br />the City of Sunny Isles Beach, Florida requesting the following: <br /> <br />1. Variance of Section 265-35 D (4)(a)(I) of the Code of Sunny Isles Beach to permit <br />proposed temporary sales office to setback 12.5 feet (75 feet required) from the front <br />(west) property line. <br /> <br />2. Conditional Use pursuant to Section 265-13 of the Code of the City of Sunny Isles Beach, <br />to permit a temporary sales office. <br /> <br />3. Pursuant to Section 265-18 of the Code of the City of Sunny Isles Beach, the applicant is <br />requesting a site plan approval to permit a temporary sales office for an approved <br />development. <br /> <br />Legal Description: The South 300 ft of the North 400 feet of Lot or Tract 1, Lying east of the <br />State Highway A-I-A (Collins Avenue) as shown on the plat entitled "Subdivision of <br />Government Lot 6, in Section 2, Township 52 South, Range 42 East, and Government <br />Lots 1, 2, 4 and portions of Lots 5 and 6, Section 11, Township 52 South, Range 42 East <br />made by Tatum's Ocean Park Co., according to the map or plat thereof, as recorded in <br />Plat Book 10 at Page 64 of the Public Records of Miami-Dade County, Florida. <br /> <br />Location: 17001 Collins Avenue; and <br /> <br />WHEREAS, the public hearing of the City Commission was advertised and held as <br />required by law and all interested parties concerned in the matter were heard, and upon due and <br />proper consideration given to the matter and to the recommendation by memorandum from the <br />Planning and Zoning Administrator and Planning Consultant; and <br /> <br />WHEREAS, notice has been provided to all interested parties regarding the application. <br /> <br />WHEREAS, the City Commission has reviewed the application, the written and oral <br />recommendations of the Planning Consultant and Zoning Director and all outside consultants <br />who render reports with respect to the site plan under review, and finds substantial competent <br />evidence to support a showing by the Applicant that the request maintains the basic intent and <br /> <br />03-Z-79 Jade Sales Office Reso. 1 <br />Legislation/Resolutions -- Ch <br />1/21/2004 --9: 15 AM <br />
