<br />RESOLUTION NO. 05-Z-89 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING THE ZONING <br />APPLICATION SUBMITTED BY FORTUNE OCEAN, LLLP, A <br />FLORIDA LIMITED LIABILITY PARTNERSHIP (Z2004-09), FOR <br />TRANSFER OF DEVELOPMENT RIGHTS ("TDRs"), IN THE AMOUNT <br />OF 59 DWELLING UNITS AND 129,216 SQUARE FEET OF FLOOR <br />AREA, PURSUANT TO SECTION 265-23 OF THE CITY'S LAND <br />DEVELOPMENT REGULATIONS (LDR's), AND SITE PLAN <br />APPROVAL, PURSUANT TO SECTION 265-18 OF THE LDR's, AND <br />THE UTILIZATION OF 1.50 BONUSES OF FLOOR AREA RATIO (FAR) <br />TO PERMIT THE DEVELOPMENT OF "JADE BEACH II", A 49 STORY, <br />256 UNIT CONDOMINIUM PROJECT, ON THE PROPERTY LOCATED <br />AT 17121 COLLINS AVENUE, SUBJECT TO CERTAIN CONDITIONS; <br />AND PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />I. RECITALS. <br /> <br />WHEREAS, on October 7,2004 FORTUNE OCEAN, LLLP (the "Applicant") <br />submitted an application to the City of Sunny Isles Beach, Florida, requesting the following: <br /> <br />1 Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting approval of the Property (hereinafter described), as <br />a Receiving Site, for 59 dwelling units and 129,216 square feet of development rights to be <br />purchased from a private seller, which application is attached as Exhibit "B" <br /> <br />2 Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting site plan approval for a 49-story, 256-unit <br />condominium project to be known as Jade Beach II (the "Project"). <br /> <br />LEGAL: <br /> <br />The North 100 feet of Tract 1, and the South 200 feet of the Lot or Tract 2, lying <br />east of State Highway A-I-A (Collins Avenue) as shown on the plat entitled <br />"Subdivision of Government" Lot 6, in Section 2, Township 52 South, Range 42 <br />East, and Government Lots 1, 2, 4 and portions of Lots 5 and 6, Section 11, <br />Township 52 South, Range 42 East made by Tatum's Ocean Park Co., according <br />to the map or plat thereof, as recorded in Plat Book 10 at Page 64 of the Public <br />Records of Miami-Dade County, Florida (the "Property"). <br /> <br />ADDRESS: 17121 Collins Avenue; <br /> <br />WHEREAS, on February 10, 2005, the City Commission conducted a public hearing on the <br />Application; and <br /> <br />WHEREAS, the public hearing of the City Commission was advertised and held as <br />required by law, all interested parties concerned in the matter were heard, and due and proper <br />consideration was given to the matter and to the positive recommendation contained in the joint <br />memorandum from the Planning and Zoning Administrator and the Planning Consultant; and <br /> <br />R05-Z-89 Jade Beach II <br /> <br />1 <br />
