<br />RESOLUTION NO. 99-Z-32 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br />OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE <br />REQUEST OF CABANAS, INC., FORA NON-USE VARIANCE <br />OF SETBACK REQUIREMENTS, SUBJECT TO CERTAIN <br />CONDITIONS; PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />WHEREAS, Cabanas Services, Inc., has applied for the following: <br /> <br />I Non Use Variance of setback requirements to permit an existing gazebo and metal shed to <br />setback 1.6 ft. from the rear east property line (5 ft required). <br /> <br />SUBJECT PROPERTY: Lot 1 Blk. 12 Golden Shores Ocean Blvd. Est. Sec "D" pb 53 pg48 <br /> <br />ADDRESS: 18655 North Bay Road. <br /> <br />and <br /> <br />WHEREAS, a public haring of the City Commission was advertised and held as required by law <br />and all interested parties concerned in the matter were heard, and upon due and proper consideration <br />having been given to the matter and to the positive recommendation of the Zoning & Code Administrator; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, THAT: <br /> <br />I. The request of Cabanas Services, Inc., for Non Use Variance of setback requirements to permit <br />an existing gazebo and metal shed to setback 1.6 ft. from the rear east property line (5 ft required) is hereby <br />approved, subject to the following conditions: <br /> <br />A. That a site plan be submitted to and meet with the approval of the Building Official upon the <br />submittal of an application for a building permit; said plans to include among other things but <br />not limited thereto, location of structure or structures, types, sizes and location of signs, light <br />standards, off street parking areas, exits and entrances, drainage, walls, etc. <br /> <br />B. That in the approval of the plan, the same be substantially in accordance with that submitted for <br />hearing entitled "Site Plan" prepared by applicant dated 4/6/99. <br /> <br />C. That the use be established and maintained in accordance with the approved plans. <br /> <br />D. That the applicant apply for and obtain a building permit for the gazebo and utility shed from <br />the Building, Planning and Zoning Department of City of Sunny Isles Beach within 90 days <br />
