<br />WHEREAS, a public hearing of the City Commission was advertised and held as <br />required by law and all interested parties concerned in the matter were heard, and upon due and <br />proper consideration having been given to the matter and to the positive recommendation of the <br />Zoning and Code Administrator; <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, THAT: <br /> <br />1. The modification of conditions are hereby approved subject to the following conditions: <br /> <br />a. The applicant provides a revised Declaration of Non-Modifiable Restrictive <br />Conditions that the property will remain an apartment/hotel, rental apartments and <br />all services provided by a hotel, including daily linen services, front desk, valet <br />and all services connected with a hotel operation and that there shall not be the <br />sale, conveyance or long-term lease or sublease (for more than six (6) months) of <br />five percent (5%) or more cumulatively, of the units to the same buyer, lessor or <br />sublessor. <br /> <br />2.
