<br />~.. _ ,....,..- <br /> <br />EXHIBIT <br /> <br />I 3 <br /> <br />OPINION OF TITLE <br /> <br />TO: MIAMI-DADE COUNTY <br /> <br />With the understanding that this Opinion of Title is furnished to Miami-Dade County (the "County"), <br />as inducement for acceptance of a Declaration of Restrictions covering the real property, hereinafter <br />described, it is hereby certified that I have examined Fidelity National Title Insurance Company's <br />Title Policy No. 5332-74144, and Attorney's Title Insurance Fund Title Computer Printouts covering <br />the period from the beginning through May 7,2001, at 11:00 p.m. (the "Effective Date"), of the <br />following described real property: <br /> <br />That portion of the North 100 feet ofthe South 200 feet of Lot 3, of Tatum's Ocean <br />Park Subdivision, according to the Plat thereof, as recorded in Plat Book 10, at Page <br />64, of the Public Records of Miami-Dade County, Florida, lying easterly of State <br />Road A-I-A, as shown in Plat Book 45, at Page 66, ofthe Public Records of Miami- <br />Dade County, Florida. <br /> <br />I am ofthe opinion that on the last mentioned date, the fee simple title to the above-described <br />real property was vested in: <br /> <br />BLUE SEAS ASSOCIATES, a Florida general partnership <br /> <br />Subject to the following encumbrances, liens and other exceptions (If "none" please indicate): <br /> <br />1. RECORDED MORTGAGES: <br /> <br />Mortgage Deed executed by Blue Seas Associates, in favor of Ocean Bank, dated July 8, 1999, <br />recorded July 8, 1999, in Official Records Book 18696, at Page 1842. <br /> <br />2. RECORDED CONSTRUCTION LIENS. CONTRACT LIENS AND JUDGMENTS: <br /> <br />NONE <br /> <br />3. GENERAL EXCEPTIONS: <br /> <br />1. Rights or claims of parties in possession not shown by the public records. <br />2. Easements, or claims of easements, not shown by the public records. <br />3. Encroachments, overlaps, boundary line disputes, or other matters which would be <br />disclosed by an accurate survey and inspection of the premises. <br />4. Any lien, or right to a lien, for service, labor, or material heretofore or hereafter <br />furnished, imposed by law and not shown by the public records. <br />5.
