O~-Z- B.5.. <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING THE <br />ZONING APPLICATION SUBMITTED BY DESERT INN BEACH & <br />TENNIS CLUB ASSOC, INC., (THE "APPLICANT"), (Z2003-13) FOR <br />TRANSFER OF DEVELOP:MENT RIGHTS ("TDRs"), IN THE AMOUNT <br />OF 65 DWELLING UNITS AND 112,905 SQUARE FEET OF FLOOR <br />AREA, PURSUANT TO SECTION 265-23 OF THE CITY'S LAND <br />DEVELOP:MENT REGULATIONS (LDR's), AND SITE PLAN <br />APPROVAL, PURSUANT TO SECTION 265-18 OF THE LDR's, AND <br />THE UTILIZATION OF 1.50 BONUSES OF FLOOR AREA RATIO (FAR) <br />TO PERMIT THE DEVELOP:MENT OF "OCEAN IV", A 40 STORY, 281- <br />UNIT CONDOMINIUM PROJECT, ON THE PROPERTY LOCATED AT <br />17201 COLLINS A VENUE, SUBJECT TO CERTAIN CONDITIONS; AND <br />PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />I. RECITALS. <br /> <br />WHEREAS, on October 14, 2003, DESERT INN BEACH & TENNIS CLUB ASSOC, <br />INC., (the "Applicant") submitted an application to the City of Sunny Isles Beach, Florida ("the <br />Application") (Z2003-13), requesting the following: <br /> <br />1 Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a transfer of 112,905 square feet of development <br />rights and 65 dwelling units from the City TDR Bank to the Project. <br /> <br />2 Pursuant to Section 265-18, of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting site plan approval for a 40 story 281-unit <br />condominium project named "Ocean IV" (the "Project"). <br /> <br />LEGAL: That portion of the South 300.00 feet of the North 400 feet of Lot 2 of Tatum's <br />Subdivision, recorded in Plat Book 10 at Page 64 of the Public Records of Miami- <br />Dade County, Florida, lying East of Easterly Right of Way of State Road A-I-A, <br />as shown by Plat recorded in Plat Book 47 at Page 101 of the Public Records of <br />Miami-Dade County, Florida, together with all riparian rights appurtenant thereto. <br />(The "Property") <br /> <br />ADDRESS: 17201 Collins Avenue; <br /> <br />WHEREAS, on June 3, 2004, the City Commission conducted a public hearing on the <br />Application; and <br /> <br />WHEREAS, the public hearing of the City Commission was advertised and held as <br />required by law, all interested parties concerned in the matter were heard, and due and proper <br /> <br />Ocean IV Final Resolution <br /> <br />1 <br />
