<br />RESOLUTION NO. 06-z-103 <br /> <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING THE <br />ZONING APPLICATION SUBMITTED BY OCEAN PALM <br />DEVELOPMENT, LLC., (THE "APPLICANT"), (Z2006-04) FOR <br />TRANSFER OF DEVELOPMENT RIGHTS ("TDRs"), IN THE <br />AMOUNT OF 33,668 SQUARE FEET AND ZERO (0) DWELLING <br />UNITS OF FLOOR AREA, PURSUANT TO SECTION 265-23 OF THE <br />CITY'S LAND DEVELOPMENT REGULATIONS (LDR's), AND SITE <br />PLAN APPROVAL, PURSUANT TO SECTION 265-18 OF THE LDR's, <br />TO PERMIT THE DEVELOPMENT OF "CHI", A 41 STORY, 38 UNIT <br />CONDOMINIUM PROJECT, ON THE PROPERTY LOCATED AT <br />15795 COLLINS AVENUE, SUB.mCT TO CERTAIN CONDITIONS; <br />AND PROVIDING FOR AN EFFECTIVE DATE. <br /> <br />I. RECITALS. <br /> <br />WHEREAS, on May 15, 2005, OCEAN PALM DEVELOPMENT, LLC., (the <br />"Applicant") submitted an application to the City of Sunny Isles Beach, Florida ("the <br />Application") (Z2006-04), requesting the following: <br /> <br />1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a site approval for a 41-story condominium <br />consisting of 38 dwelling units. <br /> <br />2. Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is also requesting the transfer of thirty-three thousand six <br />hundred sixty-eight (33,668) square feet and zero (0) units of development rights from <br />the City's Transfer of Development Rights Bank ("Bank"). (An adjustment to be made <br />for a decrease of 33,668 sq. ft. and eighteen (18) units from the City's Transfer <br />Development Rights Bank). <br /> <br />LEGAL: Lot 79 of TATUM'S OCEAN BEACH PARK, according to the Plat thereof, as <br />recorded in Plat Book 5, at Page 35, of the Public Rccords of Miami-Dade <br />County, Florida, which lies East of the Easterly right of way line of State Road <br />A-I-A per State Road Right of Way Map Section 8 7060-2104, Miami-Dade <br />County, Florida. <br /> <br />ADDRESS: 15795 Collins Avenue; <br /> <br />WHEREAS, on October 17, 2006, the Special City Commission conducted a public <br />hearing on the Application; and <br /> <br />WHEREAS, the public hearing of the City Commission was advertised and held as <br />required by law, all interested parties concerned in the matter were heard, and due and proper <br /> <br />R06-Z-I03 Ocean Palm-Chi (15795 Collins) Tdr Reso <br /> <br />Page 1 of 10 <br />
