<br />Chi Rev 10-10-06 <br /> <br />(3) That the Applicant shall comply with all City Ordinances applicable to development and permit <br />approvals. <br /> <br />(4) Failure to pay the Ten Percent Deposit within three days of the approval of the purchase price on <br />October 17, 2006, but in no event later than 5 p.m. on Friday, October 20, 2006, shall result in an <br />automatic voiding of the Commission approval of the Receiving Site, and transfer of TDR's, site <br />plan pursuant to Section 265-23.5(b)(2) of the TDR Ordinance, each element of the Application shall <br />be deemed denied, and Applicant shall not be permitted to re-file an application for development of <br />the Property for one year. <br /> <br />10 <br />
