Associates <br />17100 Collins Avenue <br />Sunny Isles Beach, Florida <br /> <br />Rc: PcdcstrianlUtility Easements <br />Porterhouse Restaurant <br /> <br />Dear Gentlemen: <br /> <br />By the attached Jetter dated February 7, 2007, you provided me with the terms and <br />conditions that 17070 Collins Avenue Shopping Center Ltd., also known as R.K. <br />Associates or Rnnaan Katz ("Applicant") are willing to provide a 5' to 10' reet <br />easement along the eastern border of the shopping centers located at 16850-17100 <br />Collins Avenue and 18090-182990 Collins Avenue. While we appreciate your <br />efforts in attempting to provide a form of mitigation for the variance request relating <br />to the Porterhouse Restaurant, the City cannot agree with all the conditions that you <br />have attached to the grant of ensements, The following conditions are acceptablc to <br />the City: <br /> <br />(1) The easemcnt will be used solely for maintenance and <br />underground of utility lines, planting and maintenance of landscape In <br />accordance with the City's Streetscape Mastel' Plan and for pedestrian <br />walkways along Collins Avenue; <br /> <br />(2) The City will be responsible for maintenance of any and all <br />improvements in the easement areas at all times and at its sole cost <br />and expenses; <br /> <br />(3) TIle use of the easements by the City shall not interfere with the <br />Properly owner's use of its property.
